Treatment vs. Homelessness, Torture and Death

Enforced psychiatric treatment and subsistence assistance under assisted outpatient treatment programs (AOT) are preferable to imprisonment for mentally challenged people. My brother and many other sick people were and are tortured and murdered every year in jails and prisons throughout the country -- if sick people live through their lunacy arrests by paranoid, untrained cops.

Enforced treatment is not needed for people who are able to manage their psychiatric conditions and stay out of jails and hospitals. However, statistics proved that AOT programs would reduce recidivism for the nation's 1.25 million mentally ill inmates, save lives, reduce homelessness, and restore many people to wholesome living.

AOT programs cost significantly less than incarceration. Consider that each inmate in New York costs taxpayers $168,000 per year to warehouse. Private prisons began AFTER budgets for America's most vulnerable people -- the mentally ill -- were cut, and they became inmates rather than inpatients and outpatients. Families throughout the country of all races are greatly traumatized when the injustice system captures and imprisons their sick relatives for behavior they could not control and breaking laws they did not understand. Only prison investors are happy about jails and prisons having become America's new mental hospitals. Mandatory AOT programs would shift most of the $80 billion+ annually that is presently going to the prison system back to psychiatric treatment and subsistence assistance.

Whereas sudden cessation of heart drugs can cause death, sudden cessation of psychiatric drugs can cause psychotic episodes that threaten not only mentally ill people but also their families and communities. I believe that most mentally ill inmates are on psychotropic drugs. To release them without a mandate for continuing their treatment under the care of a qualified mental health facility is dangerous for them and for society. To release mentally challenged inmates without provisions for their nutrition and housing is unethical and immoral - a setup for their return to prison or worse.

People who are beyond making rational decisions are disabled and deserve food and housing as well as appropriate medical and psychiatric treatment whether or not they agree. What are your thoughts on mandatory AOT programs for all mentally ill people upon prison and jail release?

Assistance to the Incarcerated Mentally Ill (AIMI) vs. USA re Mentally Illness in America

On the first Saturday and Sunday of each month, potential claimants for "AIMI vs. USA" meet in a phone conference to discuss our cases at 9am Pacific, 10am Mountain, 11am Central, and 12pm EDT. Assistance to the Incarcerated Mentally Ill (AIMI) plans to file an action in International Court on behalf of mentally ill and drug/alcohol addicts in America, demanding restitution for long-term homelessness, torture, and deaths. We also discuss AIMI's List of Suggested Changes for United Nations' directives to the USA to decriminalize mental illness and comply with the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment.

You can connect with the conference at FreeConferenceCall.com dial-in no. (605)562-0020, Meeting ID Code: 992-212-650. If that presents a problem, please hang up and dial the backup number (805)360-1075. You can also connect at Blogtalkradio: (347)857-3293. Everyone who is prevented from calling is requested to please dial Mary Neal's home number and report the unlawful interference at (770)879-5163. Freedom of speech and peaceful assembly are our rights.

Up to 100 mentally ill people or their families or survivors will be claimants in "AIMI vs. USA," in International Court in 2015 to bring exposure to cruel and unusual treatment of persons with mental disabilities and addictions. Your participation is invited. Whether or not you wish to become a Claimant, you may have suggestions related to our List of Suggested Changes that will be presented to the UN.

Mental illness affects all Americans, whether directly or indirectly. Over half of the nation's prisoners are mentally ill. Our present prison costs are over $80billion per year. Nobody can be punished into a state of mental health. Treatment should replace punishment for mentally ill people and drug/alcohol addicts in the USA.

Paragraph 1 repeated: Enforced psychiatric treatment and subsistence assistance under assisted outpatient treatment programs (AOT) are preferable to imprisonment for mentally challenged people. My brother and many other sick people were and are tortured and murdered every year in jails and prisons throughout the country -- if sick people live through their lunacy arrests by paranoid, untrained cops.

Rev. Pinkney's Life, Work and Persecution

The Life, Work, and Persecution of Rev. Edward Pinkney
October 29, 2014, 7pm to 9pm EDT, call-in number (347) 857-3293 for "Human Rights Demand" channel on Blogtalkradio
http://www.blogtalkradio.com/humanrightsdemand/2014/10/29/the-life-work-and-persecution-of-rev-pinkney

YOU are invited to celebrate the life and work of Rev. Edward Pinkney and object to his wrongful prosecution. Rev. Pinkney is a renowned human rights activist who inspires exploited people to resist oppression in Benton Harbor, Michigan, throughout America, and internationally. He has fought injustice and tyranny for decades and experienced many victories for the People. Rev. Pinkney stands against the marriage of government and corporations as well as aggressive policing tactics, regardless of personal risks. "The Life, Work, and Persecution of Rev. Pinkney" radio broadcast is an opportunity to learn more about Rev. Pinkney and show support as he faces election fraud charges before an all-white jury in Berrien County, Michigan. It was probably no accident that Rev. Pinkney's trial began on October 27, his birthday.

Rev. Pinkney's prosecution stems from his organizing a recall petition for Benton Harbor's mayor, who is perceived to work for corporate interests and not Benton Harbor constituents. Since the prosecution admits there is no evidence connecting Pinkney to election fraud, we must assume that Pinkney is being prosecuted because of his many years of human rights advocacy. Therefore, he is being persecuted as a representative of the People, and the People must respond.

Martin Luther King, Jr. said, "Cowardice asks the question, 'Is it safe?' Expediency asks the question, 'Is it politic?' But conscience asks the question, 'Is it right?'" Thousands of Rev. Pinkney's supporters are not able to travel to Berrien County Courthouse to support him this week. It is right for us to unite and publicly support this human and civil rights luminary on radio. Let your voices be heard!

Please limit your statements to two minutes. Please introduce yourself and tell why you support Rev. Pinkney. For example, "My name is Mary Neal. I am director of Assistance to the Incarcerated Mentally Ill and the Human Rights for Prisoners March. I support Rev. Pinkney because he speaks truth to power and gives a voice to the voiceless. I am grateful for his Sunday radio shows, which he faithfully makes available as a community platform."

Rev. Pinkney and his family will be interviewed during the first 45 minutes of the broadcast on October 29. Guest speakers will include Ralph Poynter, Larry Pinkney, Randy Short, Rozy Wow and many callers from the public who use this opportunity to voice their support of Rev. Pinkney.

We don't have to rely on mainstream media to publish information about Rev. Pinkney's "Life, Work, and Persecution" in a favorable light. Please share the link to Wednesday's broadcast with your contacts, and invite callers to phone in their support for Rev. Pinkney. They will have several opportunities to speak during the broadcast, with two minutes for each caller. Thank you for participating. Blessings.

Native American TB Blankets, African Ebola and AIDS

~ An African Beach ~

Every time I add this description to the photo above of a beautiful African beach, Facebook changes my cover photo to one without the description. This happened five times. Do you wonder why? I wrote:

There is a REASON why these incurable diseases appear repeatedly in #Africa - a beautiful continent that is rich in diamonds, natural resources, unspoiled beaches, and exotic animals - and occupied by dark-skinned indigenous people.

Thou shalt not covet thy neighbour's house, thou shalt not covet thy neighbour's wife, nor his manservant, nor his maidservant, nor his ox, nor his ass, nor any thing that is thy neighbour's. ~Exodus 20:17

If human rights violators would like to keep secrets, they should perhaps TRY SOMETHING NEW.
Defeating indigenous people by disease was old news long before this writer was born. See the following statements regarding the genocide against American Indians:

Colonel Henry Bouquet wrote, "I will try to inocculate the Indians by means of Blankets that may fall in their hands, taking care however not to get the disease myself. As it is pity to oppose good men against them, I wish we could make use of the Spaniard's Method, and hunt them with English Dogs. Supported by Rangers, and some Light Horse, who would I think effectively extirpate or remove that Vermine."

In response, also in a postscript, British Governor General Amherst replied:

"P.S. You will Do well to try to Innoculate the Indians by means of Blankets, as well as to try Every other method that can serve to Extirpate this Execrable Race. I should be very glad your Scheme for Hunting them Down by Dogs could take Effect, but England is at too great a Distance to think of that at present."

Oct 22 Coalition Against Police Brutality

The October 22 Coalition to Stop Police Brutality, Repression and the Criminalization of a Generation has been mobilizing every year since 1996 for a National Day of Protest on October 22, bringing together those under the gun and those not under the gun as a powerful voice to expose the epidemic of police brutality.

The Coalition also works on the Stolen Lives Project, which documents cases of killings by law enforcement nationwide. The second edition of the Stolen Lives book documents over 2000 cases in the 1990s alone. Volunteers are needed to help with the research and editing of cases since then. I helped to advertise the October 22 Coalition meetings today in two of my blogs:
http://freespeakblog.blogspot.com/2014/10/oct-22-coalition-against-police.html
http://hreventsbymlj.blogspot.com/2014/10/october-22-coalition-demonstrations.html

As the director of Assistance to the Incarcerated Mentally Ill, I certainly looked forward to the October 22 Coalition protest in Atlanta today. Unfortunately, my elderly mother is unwell and I may not be able to attend. Therefore, I ask that organizers please be mindful that over 50 percent of police violence victims are people with a history of mental illness. They are attacked and often killed by police in their homes, on our streets, and behind bars. The mentally ill also comprise over half of America's prisoners: 1.25 million sick people are wrongly incarcerated rather than treated in their communities or mental hospitals. Budgets for mental health care were cut in order to arrest sick people and start America's private jail and prison system. In Atlanta, homeless shelters are being closed so that more of these people will be arrested than before. Two homeless shelters already closed, and the Atlanta Task Force, which houses some 900 people, is fighting in court to survive. Mercenary people want the prime Midtown Atlanta property where the Task Force sits, and prison investors want the homeless jailed.

In 2014, we were made aware of numerous murders against people with mental illness, including Jerome Murdough, who was baked to death in Rikers Island, Darren Rainey, who was boiled to death in Dade County Correctional Facility, and too many more to name. Recently, Milwaukee's police chief fired an officer who picked a fight with a mentally ill teenager in the park then shot him 14 TIMES. Police aggression is directed mostly at black people and the mentally ill of any race. We need to talk about this and make sure everyone is aware of the numerous assaults on society's most vulnerable members. As usual, the victims are mostly people who are black, brown, or poor.

I would be grateful if you mention the fact that most victims of police violence and brutality behind bars are also mentally ill people. There are approximately 80,000 inmates in cruel solitary confinement today, and over 60 percent of them are mentally ill. Approximately 80 percent of inmates in SHU are black. There seems to be no attempt on the government's part to end torture of American prisoners. In fact, Solitary Watch revealed that in the U.S. report to the United Nations that will be filed in November denies that solitary confinement is systemically used against juveniles and the mentally ill in America.

These are a few of the concerns that I wanted to address today at the October 22 Coalition protest in Atlanta, but I must ask that you do this instead. Please don't let oppression of our people who experience mental disabilities go without mention. AIMI plans an International Court action for 2015, when we will take such murders as my own disabled brother suffered before the United Nations and the world. Learn about it at http://aimi-humanrights.blogspot.com

I am very grateful to the sponsors and organizers of the October 22 Day of Remembrance and protest against police violence. It means a great deal to me as the sister of a man who was secretly arrested for 18 days and murdered in jail, especially since Larry Neal's murder was covered-up. Cover-ups of jailhouse murders are possible to a greater degree than murders that happen in public where people film police violence. I am thankful that due to many news reports, especially by the Miami Herald, many jailhouse murders of mentally ill people and others are being revealed to a greater extent than before despite cover-ups.
Please send me a report after today's protests in Atlanta. See more information in the three links below, and my brother's website is in the signature block. Blessings.

U.S. to U.N.: What Prisoner Torture?

Families of mentally ill American inmates were astounded to read the headline below in Solitary Watch.com: U.S. Government Tells UN Committee on Torture: “There Is No Systematic Use of Solitary Confinement in the United States”

I published the following comment at the article:
With so many super max prisons and solitary jail/prison cells in the USA, it is surprising that the USA would deny its systemic use of solitary confinement. It is estimated that roughly 80,000 inmates are in solitary confinement, some for decades. Over 60 percent of the isolated inmates are mentally ill people who should be treated as psychiatric inpatients or outpatients, not punished for offenses that arose from their health disabilities. Assistance to the Incarcerated Mentally Ill (AIMI) plans to file an action in International Court against the USA for long-term homelessness, brutality and wrongful deaths of mentally ill Americans, especially mentally ill inmates who were denied timely psychiatric treatment to prevent offenses that led to harsh punishment. Google “AIMI vs. USA,” which will be filed in 2015. Listen to our Blogtalkradio shows on Wednesdays at 8pm Pacific Time to hear from families in mental health crises. Torturous solitary confinement and denial of visits are two of the most common complaints among family members of mentally ill inmates. [This news was discussed during our regular Wednesday radio episode of Assistance to the Incarcerated Mentally Ill at 8pm Pacific on October 15, 2015, which is archived at Blogtalkradio at
http://www.blogtalkradio.com/nnia1/2014/10/16/assistance-to-the-incarcerated-mentally-ill ]

According to Solitary Watch, the USA plans to deny systemic use of solitary confinement in its report to the United Nations and claim that American citizens are protected by the U.S. Constitution from such cruel and unusual punishment. The report says in part:
The United Nations Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT) forbids “any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person” for the purposes of intimidation, coercion, forced confession, or punishment, “when such pain or suffering is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity.” The United States asserts that it is in all cases in alignment with CAT. See the "protections" that Americans allegedly have:

The U.S. Constitution, along with federal and state laws, establishes standards of care to which all inmates are entitled…U.S. courts have interpreted the Eighth and Fourteenth Amendments of the U.S. Constitution as prohibiting the use of solitary confinement under certain circumstances, especially with regard to inmates with serious mental illness or for juvenile detainees. (Specifically, under the Eighth Amendment’s prohibition against “cruel and unusual punishments,” correctional facility administrators may not subject inmates to solitary confinement with deliberate indifference to the resulting serious harms, including suicides, suicide attempts, and serious self-injury. See Farmer v. Brennan, 511 U.S. 825, 843 (1970); see also, e.g., Madrid v. Gomez, 889 F. Supp. 1146, 1265 (N.D. Cal. 1995) (using prolonged solitary confinement on prisoners with serious mental illness can be “the mental equivalent of putting an asthmatic in a place with little air to breathe”) …

People with mental, physical, and psychological disabilities are not punished with solitary confinement, the U.S. report asserts:

The Americans with Disabilities Act of 1990 (ADA) and the Rehabilitation Act of 1973 (Rehabilitation Act) restrict and regulate the use of solitary confinement for persons with disabilities. Title II of the ADA, 42 U.S.C. 12132, applies to state actors, while the Rehabilitation Act applies to federal correctional facilities and correctional facilities receiving funds from the federal government. Both statutes prohibit the use of solitary confinement in a manner that discriminates on the basis of disability instead of making reasonable modifications to provide persons with disabilities access to services, programs, and activities, including mental health services. See Pa. Dep’t of Corr. v. Yeskey, 524 U.S. 206, 210 (1998).

THE UGLY TRUTH:  In addition to solitary confinement being systemically used to contain mentally ill inmates, juveniles, and many other prisoners (including those who refuse to work free or nearly free), it is further used to force potentially innocent defendants into plea bargains with trials denied. This typically happens to African Americans. Black people, especially men, are sometimes denied their Sixth Amendment right to fair, speedy, public trials, represented by adequate defense counsel, i.e., Shannon Nyamodi of North Carolina (two years), Terrell Scott of Pennsylvania (five years), and Kalief Browder of New York (three years). Black mental patients regularly experience indefinite detention without trials, which is cruel and unusal punishment. Two unfortunate examples are Mississippi inmates Marktain Kilpatrick Simmons (eight years) and Lee Vernel Knight (seven years).

Numerous commentators at the Solitary Watch article are incredulous over the prospect of the U.S. State Department denying the “systematic use of solitary confinement” in American prisons. Eileen Siple wrote,"In many counties in the US, including Harford County, MD, juveniles charged as adults are automatically placed in solitary within adult jails and prisons “for their own protection”. This can go on for months or years – until they are bailed out, waived down (unlikely), turn 18, or their cases go to trial. Isn’t that systematic?"

How can the State Department deny systemic use of solitary confinement and other torture against American prisoners with evidence and witnesses to the contrary? For example, "Dog Justice for Mentally Ill" blog carries numerous reports and videos documenting brutality and deaths of mentally ill victims in custody, which were also published on mainstream news broadcasts. The denial of systemic prison torture may be possible because a minute percentage of human rights complaints the United Nations receives originate in the United States. In "AIMI vs. the USA," the International Court will be presented with evidence that police and correction officers' often torture, brutalize and sometimes kill mentally ill Americans without incurring criminal charges. Cover-ups are more likely to follow such abuses and deaths. In addition, cruel and degrading treatment against prisoners frequently extends to family members and advocates who demand justice. Following the secret arrest and wrongful death of Larry Neal, this writer's disabled brother who was a lifelong schizophrenic heart patient, his family endured censorship, surveillance, and financial persecution for requesting an explanation about his kidnapping and murder in Memphis Shelby County Jail in 2003. Retaliation for exposing crimes against humanity in America's justice system is common, but human rights advocates must not be deterred. "Silence is the deadliest weapon of mass destruction." ~ Cynthia Mckinney

Catch a Nigga by His Toe

Black youths, Americans with mental disabilities, and other marginalized people in the USA are regularly detained in prisons and jails with trials denied unless they agree to plea bargain. These defendants are usually subjected to torturous solitary confinement and other abuses in order to rid them of such lofty notions as having their day in court. Certain defendants are denied their Sixth Amendment right guaranteeing a speedy, fair, public trial, with adequate representation by competent legal counsel.

Indefinite detention without trial is more likely to happen to innocent than to guilty defendants. When prosecutors do not expect to win a guilty verdict, trials are denied and defendants are strong-armed into plea bargains just to gain jail release, sometimes after many years of wrongful arrest. It appears that defense attorneys and judges are sometimes participants in conspiracies to enforce plea bargains. The Terrell Scott case in Pennsylvania and the Shannon Nyamodi case in North Carolina are two examples of indefinite detention in torturous conditions to enforce plea bargains. This illegal practice is probably a by-product of the for-profit prison system. Today we are invited to consider the Kalief Browder case with DemocracyNow.org. Please see an excerpt below:

Accused of Stealing a Backpack, High School Student Jailed for Nearly Three Years Without Trial ~ We look at the incredible story of how a 16-year-old high school sophomore from the Bronx ended up spending nearly three years locked up at the Rikers Jail in New York City after he says he was falsely accused of stealing a backpack. Kalief Browder never pleaded guilty and was never convicted. Browder maintained his innocence and requested a trial, but was only offered plea deals while the trial was repeatedly delayed. Near the end of his time in jail, the judge offered to sentence him to time served if he entered a guilty plea, and warned him he could face 15 years in prison if he was convicted. But Browder still refused to accept the deal, and was only released when the case was dismissed. During this time, Browder spent nearly 800 days in solitary confinement, a juvenile imprisonment practice that the New York Department of Corrections has now banned.

Germs Sought for Black Genocide in South Africa

BBC News apparently carried a report on June 12, 1998 called, "World: African Apartheid government sought germs to kill blacks." An excerpt from the article is below:

A South African scientist has told the Truth and Reconciliation Commission that the apartheid government considered trying to develop a bacteria which would kill only blacks.

The former head of a military research laboratory, Daan Goosen, told the commission that the project had the backing of South Africa's then Surgeon General, who described it as "the most important project in the country."

Although the substance was never developed, Mr Goosen said that an unknown European scientist claimed to have developed a strain of bacteria in the early 1980s "capable of killing pigmented people." Read the entire article at the link below:
