Memphis Police Bogus Prayer Vigil

MEMPHIS POLICE DEPARTMENT is up for accreditation by the Commission on Accreditation of Law Enforcement Agencies, Inc. (CALEA). Your comments are invited if you have an opinion about the law officers who secretly arrested mentally, physically disabled Larry Neal in 2003, hid him 18 days in jail while lying to his family and social worker ("We don't have him"), then returned the naked body of this harmless middle aged heart patient and denied the Neal family any excuse, explanation, investigation, arrest reports, or due process of law. The Neal family does not even know how they killed Larry - Taser, restraint chair, heinous medical experiments . . . (Eleven url links are in this article.) The brutality and murders of mentally ill people in Memphis did not stop with Larry's death, and neither is police violence limited to them. At least 11 people in Memphis were killed under the color of law in 2012, and two were already shot dead by MPD in 2013. Some of the victims' families are also DENIED open records. As Memphis Police Department braces for the accreditation review, MPD scheduled a prayer vigil for February 2, 2013. (Eleven links are in this article.) Black churches will be up front for the event, called "Hands Around 201 Poplar." I do not know how many of the pastors are on Homeland Security's "Clergy Response Team" and payroll. Of course, one does not have to be a CoIntelPro preacher to pray for police officers, but ministers of God owe honesty to police officers and all people. Repentance is God's requirement for forgiveness. Black Autonomy Copwatch does not believe that requirement has been fulfilled, and it has not. In retaliation for the Memphis Black Autonomy Federation's letter to the Commission on Accreditation for Law Enforcement Agencies opposing the accreditation of the Memphis Police Department and in an attempt to discredit and disrupt our upcoming March 15-16 International Days of Action Against Police Brutality, Mayor AC Wharton and city officials, who have enlisted black churches as a front, are putting on a pro-police prayer "vigil" this coming Saturday (see news article, http://wreg.com/2013/01/29/hands-around-201-poplar/)

The so-called vigil, "Hands Around 201 Poplar," is being orchestrated by city officials and billed as "a stand against crime." But the mayor, the city council, the black ministers, and their allies almost never about the crime of police brutality in Memphis.

It is a crime that two Memphis cops shot and killed Steven Askew, 24, on Jan. 17, 2013, while Askew slept in his car with a gun reportedly on the front seat--a gun he was licensed to carry.

It is a crime that MPD officer Terrance Shaw shot and killed 15-year-old Justin Thompson on Sept. 24, 2012, claiming that Thompson tried to rob him. Why couldn't Shaw, a trained cop, subdue this boy (if, in fact, Thompson needed to be subdued) without killing him? Will the investigation into Thompson's death ever be released to the public, or will the cover-up continue?

It is a crime that police beat and choked Lorenzo Davis, 28, to death on July 3, 2012, for allegedly possessing drugs. The medical examiner claimed that Davis died of cocaine poisoning, but doctors at Methodist Hospital who examined him told his mother that the only drug in his system was Tylenol.

It is a crime that Memphis police shot and killed Hernandez Dowdy, 38, on June 27, 2012, for stealing a car that was never really stolen because the white woman who owned the car filed a false police report.

It is a crime that at least 10 other people have died at the hands of Memphis police officers since Feb. 10, 2012.

It is not likely that much, if anything, will be said about these crimes of police murder at Saturday's "vigil." At our march and rally on Friday, March 15, and our mini-conference on Saturday, March 16 (details to follow), the Memphis Black Autonomy Federation, family members of people killed by the police, others who oppose police terror and corruption, including you, we hope, will protest the crimes committed by the Memphis police and begin to build a network of activists to fight police brutality in the Mid-South and around the country. We are not at all fooled or intimidated by the fake "vigil." We see it for what it is--a desperate attempt by city officials to disrupt, discredit and destroy the movement against police brutality that is developing in Memphis.

The Johnnie Cochran Firm!
Lynching is illegal!
You might get prison terms!”
 
“Over that sick coon? We doubt it!
But give it your best shot
We told him to stop singing loud; move on
But he would not!”
 
Mama cried silently as she signed her name
On the Cochran Firm’s contract
“Don’t let them kill other sick sons
Nothing can bring mine back.”
 
Lawyers gave us their assurance
And lots of tissues, too
Saying, “Dry your eyes, old Mama
We’ll get justice for you.”
 
But The Cochran Firm tricked us
Their promises were only lies
They held Larry’s case inactive
And never asked how he died

Were false, every one!
The Cochran Firm worked for the jail

Our "Inalienable Rights "Are Really Quite Alienable

I greatly admire U.S. Supreme Court Justice Antonin Scalia's honesty. He said, THE CONSTITUTION IS "NOT A LIVING DOCUMENT. IT'S DEAD, DEAD, DEAD." He said this on January 28, 2013, at Southern Methodist University.  Our civil rights are supposedly protected by the U.S. Constitution. Did I not publish this truth a couple of years ago? I was shocked when I learned we have no respected rights, and I believed that telling the public would make a difference.

UPDATE March 3, 2014: A year later, we have another reason to admire Justice Scalia, a man who gives us the hard truth. Justice Scalia reports that we have every reason to expect Americans to again be interned in concentration camps. Justice Scalia is also the justice who pointed out that courts are not impaired to consider PROOF of ACTUAL INNOCENCE once a person has been convicted of a crime, even when such persons face the death penalty. He made that statement when Troy Davis's case was taken to the Supreme Court in his quest for a new trial. Memphis Police Accreditation Review - Feb 4

On Monday, Feb. 4. Memphis residents will have a rare opportunity to make complaints about brutality and misconduct committed by the Memphis Police Department to investigators for the national agency that will decide if the MPD will keep its status as a nationally accredited department. The Commission on Accreditation for Law Enforcement Agencies will conduct a public session on Feb. 4 at 5:30 p.m. at the MPD station at 949 E.H. Crump Blvd. At this time, members of the community may make complaints about the MPD. If you cannot attend this session, you may make comments to the accreditation team (anonymously, if desired) by phone on Feb. 4 from 1-3 p.m. by calling (901)636-3904. We cannot afford to miss this opportunity to let the CALEA know about the violence and corruption rampant within the MPD. The CALEA needs to know that at least 11 people died at the hands of the MPD in 2012, including 15-year-old Justin Thompson, shot to death by off-duty MPD officer Terrance Shaw on Sept. 24, 2012. It has been four months since Justin was killed, yet no public report has been issued about his death. We talked to his mother last week, and she said the police have told her nothing about the investigation.

We are still in the first month of 2013, and MPD officers have already shot and killed two men. 1. http://wreg.com/2013/01/18/man-shot-killed-by-memphis-police/ -- According to Channel 3 news, the family of the dead man in this case, Steven Askew, has hired a lawyer and plans to file a lawsuit against the MPD.

2. http://wreg.com/2013/01/11/police-shoot-and-kill-man-while-serving-warrant/, This man was allegedly abusing animals.

Just yesterday, an MPD officer was suspended after he was accused of sexually assaulting a 21-year-old woman on Sunday. In September, 2012, MPD patrolman Sean McWhiter was charged with sex trafficking. Also, in September, 2012, MPD officer Margaret Taylor was charged with assaulting three youths, ages 10, 13 and 16.

The list of violent and corrupt MPD cops could go on Altogether, in 2012, over 25 MPD officers were arrested. This is important information that the CALEA needs to know. With a record like this, the MPD should not be accredited again.

We must make our voices heard, and spread the word to others about the Feb. 4 hearing. We especially encourage the families and friends of people who were killed or brutalized by the MPD to attend the CALEA hearing and speak out. Black Autonomy Copwatch, a project of the Memphis Black Autonomy Federation, will be there. We hope to see you. We canot let the MPD get away with claiming to be a model police department.

Finally, it is great that Steven Askew's family plans to seek justice for his death. However, lawsuits alone will not get justice for the mistreatment that you, family members, or friends may have received from MPD officers. Nor will lawsuits alone obtain justice against the police who may have killed your loved ones. There needs to be a movement in the streets against police brutality and misconduct, that puts pressure on the local government and the cops. It's the only way that victims and their families can win anything. Power concedes nothing without a demand, and it never will!

When a 70-year-old defendant is overly sentenced (10 years for delivering a letter) and reportedly denied cancer treatment while incarcerated, that could be a back door death penalty. This seems to be the plan for Lynne Stewart, a human rights advocate and former activist attorney. Stewart was imprisoned for distributing press releases on behalf of her client, Sheikh Omar Abdel-Rahman, a/k/a "the blind sheik of Egypt." She also defended numerous members of the Black Panther Party and other oppressed persons, frequently receiving little or no pay.

Ralph Poynter, Lynne's husband of nearly 50 years, addressed the National Lawyer's Guild convention in October 2012, in Pasadena, California. As his speaking time was running out, before the end of the speech, Poynter called upon the delegates to stand as a commitment to support Lynne’s struggle for justice and freedom, at which time the Guild members provided a thundering standing ovation. The text of his speech is below.

Brothers and Sisters, Comrades, Supporters and Friends, I hope you’re not saying Lynne Stewart is just old news. Those of you who know her personally and remember her at these conventions know she will always be a vital force among us. Those of you who were still in high school when she was arrested back in 2002 owe it to yourselves to find out about her, her career, and her case, which is still crucial to all that the Guild stands for.

Let me just say that I am Lynne’s husband and a lot prejudiced in her favor. I have lived with her, fought with her and beside her, and loved her for almost 50 years. I want her to be out of Prison where she has languished for the last three years. Did I say languish? – Lynne can’t languish – she is always the activist, always political, always compassionate. They can’t jail her spirit. But WE need her out here with us on the front lines!

The federal government locked her up because they wanted to control her defense of Sheik Omar Abdel Rahman and she believed that ethically and morally she had obligations to her client; and that her adversary should not, could not, dictate or curtail what strategy a lawyer must adopt. Maybe you would not have been audacious in the same way Lynne was, in issuing a press release, but she was representing a man who had been subjected to a vicious solitary confinement for many years, was ill, and appeared to be fading. It was “mandatory” to do this to save him. Now that Mubarak has been toppled and the new President has been calling for the repatriation to Egypt of that client, Sheik Omar; Lynne was right, and the lie has been put to the government’s strident and false claims that her actions somehow contributed to terrorism. And we are still fighting her case – now in a petition for Certiorari to the US Supreme Court due in December.

The last thing I want to speak on at this convention of lawyers are the legal arguments that are available in Lynne’s petition and the chances that any of them might have before the Supremes.

Many of you are familiar with the trial and have followed her appeal, and then her re-sentencing, and that appeal. I do want to say that Lynne’s case should be important to all criminal defense lawyers and particularly to Guild lawyers because what the Government has done to her can happen again. And it can particularly happen to Guild lawyers who regularly take on the cases of people whom the Government despises and who they believe cannot be permitted to win. In essence, using regulations promulgated by the Department of Justice and Bureau of Prisons, Lynne’s adversaries attempted to thwart her campaign to keep her client alive in Egypt and the world. Her press release, not secret, to Reuters, mirrored the many that her co-counsel Ramsey Clark had issued in the face of the same regulations. But they came after her. She is nothing more, or less, than a smart woman with great politics from a working class background. But her amazing loyalty and relationships with her clients were a threat.

Lynne’s case is important for all of you to support because someday you may be confronted in your professional life with a choice between conforming to conduct that pleases the “system”, “authority,” and doing that which you know to be right and just. Lynne chose her client and her obligation to him, and if you want to increase the safety zone for lawyers centered as she was, you will support her. To be reminded of just who Lynne is, she asked me to read a portion of a speech she gave to the Guild in Minneapolis at the convention there in 2007. It is her credo:

“I believe we have formidable enemies not unlike those in the tales of ancient days. There is a consummate evil that unleashes its dogs of war on the helpless. Our enemy is motivated only by insatiable greed with no thought of other consequences. In this enemy there is no love of the land or the creatures who live there, no compassion for the people. No thought of future generations. This enemy will destroy the air we breathe and the water we drink as long as the the dollars keep filling up their money boxes.

We have been charged here, once again, with, and for our quests, … to shake the very foundations of the continents. We go out to stop police brutality; to rescue the imprisoned; to change the rules for those who never have been able to get to the starting line, much less run the race, because of color, physical condition, gender, mental impairment.

“We go forth to preserve the air and land and water and sky and all the beasts that crawl and fly. We go forth to safeguard the right to speak and write; to join; to learn; to rest safe at home, to be secure, fed, healthy, sheltered, loved and loving, to be at peace with one’s identity.

“Our quests are formidable. We have in Washington poisonous government that spreads its venom to the body politic in all corners of the globe. We have wars – big war in Afghanistan, smaller wars in Palestine, Central Africa, Columbia, Kashmir …. Now we have those Democratic and Republican candidates and then an election, with the corporate media ready to hype the results and drown out the righteous protests.”

I now need to raise to you the plight of political prisoners in the US, (not just because Lynne is one) – numbering more and more Muslims, Earth Firsters, veterans of the 1960s, 70s, and 80s defense of minority communities, resisters, peace activists… brave men and women, held in the harshest conditions, some for more than 40 years. This is more than a worthy focus for Guild lawyers, whose opposition to illicit power should be consistent and militant. Check these folks out at Jericho and Project Salam websites. And join their struggles. Many have no legal representation or contact. Even if you correspond, or visit, or join a defense team, or take on one of their cases, your reward will be great – the satisfaction of doing the right thing with people who remain the best among us.

In closing I want to urge you to defend and champion Lynne Stewart, one of our own! Defend and champion all political prisoners! Set her free! Set ‘em all free!

American prisoners are sometimes brutalized and killed in custody, and families may be censored and terrorized to contain the information. In 2008, high government officials were indicted on allegations that they suppressed investigations following prisoner murders and brutality because they owned prison and jail stock or in exchange for same. The case did not go to trial. The United States Department of Justice (USDOJ) suppressed an investigation of Larry Neal's 18 days of secret arrest in Memphis Shelby County Jail and his murder on August 1, 2003. The USDOJ also allowed the jail, which was already under its direct supervision due to lawsuit by the United States, to submit false testimony and reports that omitted the mentally, physically disabled black man's death from reports the jail made to the feds. This huge cover-up was/is facilitated by a corrupt law firm, The Johnnie Cochran Firm, sold-out American press, state bars, government representatives, judges, and human/civil rights organizations. I am greatly censored to hide the fact that DISABLED CITIZENS OF THE UNITED STATES ARE KIDNAPPED AND KILLED WITHOUT ACCOUNTABILITY IN GOVERNMENT FACILITIES. 

I hoped more information about inhumane treatment of Larry Neal and other prisoners would have been aired on Press TV's documentary, "The Facade of the American Dream." But perhaps my entire interview will be shown on another documentary. Bill Windsor, executive producer of "Lawless America - The Movie," and hundreds of whistleblowers will meet in Washington, D.C. on February 4 to present testimony to Congress about corruption in government, especially the justice system. The Cochran Firm contracted with Hattie Neal, 80, to represent the survivors of Larry Neal, her mentally and physically disabled son. Larry was a heart patient who was killed after 18 days of secret arrest in Memphis Shelby County Jail. The Cochran Firm did no substantive work regarding Larry's secret arrest and death during the Tennessee statute of limitations, although it sent the family lying updates. When the family sued The Cochran Firm for fraud and malpractice, the firm denied even having a Memphis office or a Georgia office. The Cochran Firm conspired with government officials to keep Larry Neal's secret arrest and murder covered-up.

6. EDWINA DAVIS MUST SURVIVE THE COCHRAN FIRM FRAUD

An Atlanta teenager was killed by police for driving a vehicle they claimed they suspected was stolen. It was his mother's Tahoe. The shooter was indicted for Ward's murder but was not tried. Crawford was a 22-year-old black father who was ambushed and killed while talking on the phone at an Ohio Walmart while leaning on a toy rifle he planned to purchase. The Cochran Firm demanded only $75,000 for Crawford's survivors, which says, "Black Lives Don't Matter."

Carter was a young black man who was arrested in Jonesboro, AR. Police claim that the youth committed suicide after being searched twice while his hands double handcuffed behind his back and he was locked in the back of their police car. Curiously, the dash cam stopped working just prior to Carter's shooting and resumed working right after. The Cochran Firm contracted with his family and never actually filed suit, as far as this writer knows. That is a specialty of theirs - stringing families along while the statute of limitations passes.

Murdough was a Marine Corps veteran who had difficulty adjusting to civilian life after military service. The homeless man was arrested when seeking a place to stay on a Harlem rooftop. 20. WHISTLEBLOWERS IN LOUISIANA contracted with The Cochran Firm to file a lawsuit against a chemical company. The lead plaintiff, who was a good swimmer and a fisherman since childhood, somehow drowned after notifying his attorney he was going fishing. The lawsuit did not proceed after his demise and other plaintiffs, who worked for the chemical company, feared for their lives. The chemical company changed its name and is still operational. An African American youth was apparently by a St.Louis police officer in 2002. On the civil trial date in 2006, Rodney Holmes, Esq., The Cochran Firm lawyer, was missing in action. He did not appear in court to defend his client's wrongful death case. Ms. Judy Nashville, mother of the deceased, Stanley Parker, 17, called The Cochran Firm frauds' office and inquired. The Cochran Firm frauds reportedly called Holmes repeatedly but claimed they could not reach the missing attorney. Former police officer Keith McGull had allegedly killed Parker for no reason in the "Michael Brown" Missouri case of 2002. The police department's lawyer reportedly told Nashville that Holmes often stood up his clients. Once again, The Cochran Firm frauds used up their client's statute of limitations then pulled their CoIntelPro trick and "disappeared" - this time on the court date.  Sixty Year-Old Mentally Ill Man Dies in Isolation Cell Hours After Police Tasing

(Sept. 17, 2012) A 60-year-old man who had long suffered from bipolar disorder died in a jail cell Friday evening, hours after police tased him and placed him in isolation. Bill Williams was arrested for shoplifting at a gas station in Snohomish County, Washington. He had recently stopped taking his medication, and his family said they called the police and his case manager the previous week saying he needed to be hospitalized, but were ignored. KIRO 7 Eyewitness News reports:

“His life was so difficult. Anyway for it to end like this, and die alone in his cell, is just incomprehensible,” said Williams’ daughter, Trina Blau. “There’s a hospital right there where they could have shot him up with a sedative to figure it out. Instead, they shot him with a Taser and he’s dead.”
