MPD Fatally Shoots Blacks; Fires Rubber Bullets on Whites



JoNina Abron-Ervin, of Memphis Black Autonomy Federation, supplied the following report:

Memphis Cops Use Rubber Bullets for a White Man But Shoot and Kill Two Black Men

On Feb. 4, a law enforcement “task force,” including Memphis police officers, shot and killed Markell Atkins, 36. U.S. marshals, who led the task force, allegedly came to the home of Atkins to serve a warrant for his arrest in the death last year of a child. The cops claim Atkins, who was black, threatened them with a knife so they killed him. Family members present at the home said Atkins was in the backyard feeding a pet when the cops came.

The very next day, on Feb. 5, Memphis cops used rubber bullets against a white man, Terry Burch, suspected of stabbing a woman, according to a local TV station. Burch allegedly had a knife, but according to the Commercial Appeal newspaper, police sent negotiators to talk to him while he was inside a house. He was later arrested and put in jail.

Less than a week later, on Feb. 10, Tony Bess, 48, who was black, was shot and killed by Memphis cops at his home. Memphis police allegedly came to Bess's home to serve a warrant for his arrest for an assault he allegedly committed this past weekend in a Memphis suburb. Initially, the cops claimed that Bess threatened them with a gun. But now, the local news media report that: 1. In the process of killing Bess, one cop shot another cop, and that 2. Bess never fired a gun that he allegedly had at the time the police came into his bedroom.

Burch is alive because he is white. Atkins and Bess are dead because they were black, gunned down by Memphis cops acting as their judges, jury, and executioners.

Atkins was the 25th person and Bess the 26th person killed by Memphis police during the reign of terror conducted by the police department beginning in February, 2012. Only one cop has been prosecuted for any of these 26 deaths.



Inquests Must Be Held in Memphis in Cases of Deadly Police Force

Memphis cops get away with murder because they are rarely ever forced to testify in court about their use of deadly force. Instead, the medical examiner, the county prosecutor, and the cops meet together in secret and decide that the killings were “justified.”

Under Tennessee law, Memphis police who kill people can be subpoenaed to testify in an inquest. For an inquest to be held, two people, preferably family members (but they don't have to be) must sign an affidavit and file it with a General Sessions Court judge, saying that they believe a person was unlawfully killed by another person. It is not necessary for the affidavit to be filed by a lawyer. Thee is no statute of limitations on murder. An inquest is a criminal proceeding. It has nothing to do with a lawsuit, which is a civil action that family members may choose to file against the police for the wrongful death of a loved one.

Will inquests guarantee an end to the reign of terror by the Memphis Police Department? No, they won't. But at the very least, inquests will require the cops to testify under oath and make it more difficult for the medical examiner and the prosecutor to cover up the truth when the police use deadly force.

 It is this writer's assumption that Memphis Police Department is excused from federal overview because of a 47-year-old cover-up involving the assassination of Rev. Dr. Martin Luther King, Jr.

Officer Wilson Acquittal: Boycott 4 Justice


1)  If Officer Wilson is Acquitted, Give No Excuse for Martial Law. BOYCOTT 4 JUSTICE. I believe marching is too dangerous and largely ineffective except for publicity, which Brown's murder already has thanks to previous demonstrations by all of the brave Ferguson protesters. At the end of this article is an alarming news alert from the City of Berkeley, Missouri, advising its citizens to take extraordinary precautions for safety in the event of Wilson's acquittal. Protesters were mostly peaceful during demonstrations immediately after Brown's murder, but police were not. Please recall that a cop was sent to stand behind Ferguson protesters and throw rocks at militarized police - perhaps to draw gunfire. Nobody is likely to be shot or arrested for not Christmas shopping. BOYCOTT 4 JUSTICE.

2)  Everyone who has children should buy each child only one toy if they celebrate Christmas, but stop purchases at that. Some Ferguson organizations plan a boycott for Black Friday (see the photograph above and a news article about the proposed boycott at the first of six links beneath paragraph no. 7). ALL of us should skip Christmas 2014 altogether if Wilson walks. Michael Brown's death must hurt Big Business, and then Big Business will demand justice for Brown and safety for other black youths. It doesn't cost elitists anything to release killer cops, and that is the problem. We must make Wilson's acquittal very expensive in order to get the Justice Department to levy federal charges against Wilson. We have the power. We have consumer power. BOYCOTT 4 JUSTICE.

3)  Send every discount coupon which you received from retailers back to retailers with "Michael Brown" written across them. Explain to children in your families why they will only receive one gift this Christmas, if they expected more. Have them to help protect THEMSELVES and their teenage siblings and cousins and friends by preparing toy ads for mailing back to stores with "Michael Brown" written across the advertisements with bold, black markers. Go online and order NOTHING. Instead send emails to manufacturers saying only "Michael Brown." Teach your children to BOYCOTT 4 JUSTICE.

4)  Boycotting is highly effective if enough people participate, but it is not as exciting as protesting. There will be no media presence and no one making rousing speeches. If you really miss the media and confrontations with police, go picket traitors going into the malls. Ask shoppers why they don't care that youths like Michael Brown are shot for walking while black. Do not block ingress and egress to and from the malls, but picketing on the sidewalks at street level should reduce the number of shoppers significantly. People were afraid and ashamed to shop in my town during boycotts in the 1960s.

5)  Picketing shoppers (with permits, if applicable) should provide the excitement and feeling of comradery that boycotting might lack. The police will surely come, but picketing at shopping malls would reduce the likelihood of police using army tanks, helicopters, rubber bullets, and tear gas on protesters, especially in Caucasian areas. If they do use such methods to violate protesters' free speech and freedom of assembly rights, watch NOBODY go shopping the following day. Success! BOYCOTT 4 JUSTICE!

6)  Not everyone can participate in demonstrations, but everybody can boycott this Christmas season, even timid or elderly people. Experience success while minimizing personal risks. Government ignores demands made by the People, but Big Business is never ignored. There is no better way to appeal to Big Business than to stop business. All of our protest marches in the 1960s had boycotts associated thereto. If success is slow, coordinate with unions and universities to add work strikes and school walk-outs. It would carry significant impact to add hotel and restaurant workers to the strike during the holidays, especially New Year's. Be effective, peaceful, and safer. 

7)  Thanks to protesters in Ferguson and throughout America directly after Brown's murder, we are set to achieve victory. All it should require to have federal charges levied against Wilson if he is acquitted is a little coordination and sacrifice - not more risks of harm. No adults ever got arrested for "not shopping", "not working," or "not going to school." BOYCOTT 4 JUSTICE. See a St. Louis Post-Dispatch article at the link below about the Black Friday boycott sponsored by a coalition of organizations demanding justice for Michael Brown. Their boycott should be observed nationally and span the entire holiday season to ensure success and bring greater respect for the lives of our young men of color everywhere. On the other hand, the article at the second link and the notice to Berkeley, Missouri citizens below should serve as a warning to everyone about where this issue can lead.

Stand Down, Ferguson: Camps Ahead

What happened during the Rodney King riots was a desperate attempt by a people who had long been deprived of due process in courts of law. For a period of time, African Americans were hopeful that police violence would be dealt with fairly in criminal and civil courts. That has not been the case. Therefore, the possibility of riots might indeed exist if Wilson is acquitted, but only because the justice system has failed to deliver on its promise of equal justice. In the event that the grand jury fails to indict, I certainly hope that there is no property damage and that no more people are hurt or killed in Missouri or elsewhere. I believe the best course of action if Wilson is acquitted is to press the U.S. Justice Dept. to levy federal charges, as was done in Rodney King's case, and that further demonstrations while tempers are high would be counterproductive.

Whereas Zimmerman was not a government employee, and the police had reportedly told him to stand down, that is not the case with Wilson. Federal prosecution should be the response to an acquittal by the Ferguson grand jury, should the acquittal occurs.

There is a time for all things. Ferguson is going to the United Nations, and the Justice Department has a job it should do to protect the right to life in the USA. Meanwhile, I caution protesters to be cognizant that in December 2011, the president signed the NDAA law, which permits the USA to detain citizens indefinitely without trial or any opportunity for defense. Many of us fought this law from coming to be, and we still oppose it. I perceive this law as a threat to the very idea of liberty and justice for every American, but particularly for the group that has the highest rate of incarceration presently, often without fair trials: African Americans.

Michael Brown was young and inexperienced, and so he died. I am convinced if he had known Officer Wilson would kill him, Brown would have obeyed Wilson immediately without words. The Ferguson protesters are not ignorant like Brown was about the viciousness of militarized police. At least two more young black men were killed in that area since Brown was, and a black woman is hospitalized with a gunshot wound to her head reportedly delivered by Ferguson police. Therefore, I implore Ferguson protesters to "go nowhere with an angry man," as the bible instructs. We have other options, the most important of which is to let tempers cool before embarking on any course of action should Officer Wilson be acquitted. History should teach us that any excuse would do to disregard the human and civil rights of African Americans, and there is a law that says "anything goes." Be angry, but exercise patience.

We have been concerned for some time about Martial Law and people being interned in the concentration camps that are waiting in America and foreign countries. It appears that the powers that should not be do not attempt to justly remedy wrongful deaths such as Brown's and my brother's and many other blacks endured in hopes that African Americans will give an excuse to institute Martial Law and use the concentration camps that are reportedly prepared, staffed, and stocked with supplies. How we respond to Ferguson if Wilson is acquitted could have eternal ramifications for all of us - meaning everyone in America. We have the ability to chose peace, which is really the only reasonable choice when opposed by such a formidable foe as this country can be if a people threatens its security.

Unless you want to be a suicide warrior and completely destroy this troubled peace we have had in this country since slavery officially ended, I advise everyone to STAND DOWN. There is a smarter way: Boycott 4 Justice.

Pam Wagner's Recent Mental Hospitalization

Assistance to the Incarcerated Mentally Ill (AIMI) members advocate online for mentally challenged people to be hospital inpatients or outpatients rather than prison inmates. However, we are aware that institutionalized persons, whether in jails, nursing homes, or mental health facilities, are at risk for abuse and that all facilities require oversight, which is the responsibility of the United States Department of Justice (link below). A dear friend, Pam Wagner, was recently hospitalized and released. Her blog offers insight into how traumatic it is for patients to be removed from their homes and hospitalized. It is even more traumatic for people suffering mental disease to be removed from their communities and imprisoned, often in isolation, and subjected to potentially deadly restraint chairs, Tasers, and chemical sprays that police frequently use to control (punish) mentally ill inmates. Please see an excerpt from Pam Wagner's blog below wherein she describes her recent hospitalization. Despite her health challenges, Pam Wagner is a noted author and poet. Many people who have mental challenges are very intelligent and have made tremendous contributions in science, the arts, government, and other areas. The fact that I have amnesia for it and for most of the Wednesday following only occurred to me on Thursday, a day and a half later, when I wondered -- the train of thought must have had to do with the seclusion episode that took place Wednesday evening and which I described in yesterday's blog post -- why they had been so violent with me, why they had so quickly secluded and threatened me with restraints in a situation that didn't come within miles of "requiring" them. Kenneth Chamberlain's Family Files $21m Lawsuit

The family of Kenneth Chamberlain, Sr. has filed a $21m lawsuit for his wrongful death. In this article with four links are excerpts from The Guardian (UK) about another African American elder who was murdered by police. Police responded with Tasers and gunfire during their home invasion when the 68-year-old retired marine's medic alert went off in White Plains, NY in November 2011.



"Make no mistake, my father was murdered," Chamberlain Jr told reporters on Monday.

On November 19, Chamberlain, who had a serious heart condition, tripped a medical alert pendant he wore around his neck. The company that supplied the pendant dispatched an ambulance to his public housing complex. Three officers already facing claims for alleged civil rights abuses – Carelli included – also responded to the scene. A little over an hour after they arrived Chamberlain had been seared with a Taser, shot with bean bags fired from a shotgun and ultimately killed by a bullet that tore through his lungs.

In a phone call with the medical company recorded after the police arrived to his home, officers are heard banging on Chamberlain's window.

"Do not do that. I'm telling you all, I'm telling you all I'm OK," Chamberlain called out to the officers. A voice then responds: "I don't give a fuck, nigger."

African American elder Kathryn Johnston, 92, was murdered during a home invasion by Atlanta police officers in 2006. My mentally, physically handicapped brother, Larry Neal, was secretly arrested for 18 days and murdered in Memphis Shelby County Jail in August 2003 under circumstances the U.S. Department of Justice and the jail refuse to divulge in order to deny my family due process of law. Black women and children are being killed by police, also. Shantel Davis, a 23-year-old unarmed New Yorker, was shot and killed by police in June 2012. Most news accounts about Davis's death focus on her criminal record instead of her brutal murder by police. She was shot as witnesses heard her cry, "I don't want to die!" The government-controlled media focuses on Davis's background as though police have the right to execute Americans without judge or jury. Aiyana Jones, a seven-year-old African American child, was shot by Michigan police in May 2010. In addition to blacks, police brutalize and kill mentally ill people of every race and ethnicity. A recent murder victim was Kelly Thomas, a schizophrenic, homeless white man who was beaten to death by six officers in Fullerton, California. In February 2012, police in Calumet City shot and killed Stephon Watts, a 15-year-old Autistic boy, after the black child threatened them with a simple butter knife. He suffered from Asperger’s Syndrome — a high-functioning form of autism — and attention deficit disorder. Police superiors and the Department of Justice should have zero tolerance for police murders instead of helping to hide the bodies. The number of African Americans and mentally challenged people killed by police and prison guards since 2000 would probably fill the wall that commemorates fallen soldiers who died in Vietnam. Even black police officers are not safe from police murders. Genocide is happening, and concentration camps are planned. As it was in Nazi Germany, the main targets are disabled people and minorities along with "dissidents" (people who disapprove). But don't say I told you, or my assigned stalkers will destroy this computer, too.

Stalkers turned loose a large bulldog in our backyard as I wrote this article. Be careful. If we have to shoot your dog because it threatens our children or cats, the police will investigate and the media may report the incident. Dogs count much more than people in the USA. Although the cover-up regarding the secret arrest and wrongful death of Larry Neal is ongoing, killing your vicious dog may blow the cover off and open the door for the Neal family to finally get "DOG JUSTICE."

Our condolences to the Chamberlains and every family suffering losses because of police violence, which has become a pandemic in African American communities throughout the country. Beginning Tuesday, May 25, 2010, I plan to STAND FOR JUSTICE in front of Fulton County Georgia Superior Court from 2:00 p.m. until 4:00 p.m.  I plan to continue to do that on a weekly basis each Monday throughout spring and summer 2010, except the week (to be announced) when I plan to go to Washington, D.C. to STAND FOR JUSTICE in all day every day in front of the unrighteous United States Department of Justice.  This week I am one day late and will begin on Tuesday.  Peaceful persons who demand change in the unjust justice system and wish to stand with me are welcome to join me.  Approximately 1 in 30 Americans are currently imprisoned or face the threat of incarceration as probationers and parolees.  Over 2/3 of them are imprisoned for non-violent offenses.  Approximately 1 in 9 African American males between the ages of 18 and 34 are prisoners.  I especially invite family members of the 1.25 million mentally ill inmates who are wrongly imprisoned in America rather than treated in their communities or in mental hospitals, depending on their mental states and offenses.  I protest slavery being moved from America's plantations to its prison system.  I protest prison profiteering, unrighteous judges, nation-wide cointelpro law firms (The (Johnnie) Cochran Firm), the death pentalty, excessive sentencing, wrongful convictions, trying and sentencing children as adults, prisoner torture and murders, police brutality, denial of justice to poor and minority families, and other human rights offenses regularly practiced in, through, and by the United States "justice" system. My sign says "WRONGFUL DEATH OF LARRY NEAL" on the front and "COCHRAN FIRM FRAUD" on the back.  Anyone who is interested or who becomes interested in joining me over the spring and summer should bring nonviolent descriptive signs without profanity that convey they are fed up enough to stand up. 

I protest being stalked online and in person and having six computer systems destroyed because illegal, mercenary canines in government and others wish to hide my handicapped brother's murder by police and The Cochran Firm Fraud. I protest being censored in a country where my male relatives fight and have fought for freedom of speech and freedom of press and other democratic ideals. I will not watch mutely while Liberty goes quietly into her goodnight.
