AIMI vs. USA International Court Action

Assistance to the Incarcerated Mentally Ill ("AIMI") plans an action in International Court to (i) win restitution for victims of human trafficking - people who were denied psychiatric and/or drug and alcohol treatment in order to enrich prison investors, (ii) win restitution for victims of mentally ill people and drug/alcohol addicts who were denied treatment, and (iii) help decriminalize mental illness and drug/alcohol addictions in the USA by demanding punitive damages for the failure of the United States, a United Nations member state, to adhere to the Universal Declaration of Human Rights, the Convention Against Torture, and other international laws, treaties, and conventions regarding human rights, particularly the rights of individuals with health disabilities. The action will be filed in 2015 by an International Human Rights Lawyer.

Please note that AIMI vs. USA will only sue for monetary damages, not for release of prisoners or policy changes. AIMI believes that if enough money is paid by the United States to persons whose human rights are or were violated, policy changes will be a natural consequence of the international exposure and financial loss resulting from this lawsuit. Claimants are encouraged to continue using regular legal channels to seek prisoners' releases and humane incarcerations. AIMI will sue for monetary compensation to our claimants for pain and suffering. Generally, persons who have already settled monetary claims for personal injuries and deaths will be ineligible as claimants for AIMI vs. USA, but feel free to apply.

Most of our claimants have a close relative or next friend who has experienced or is experiencing long-term homelessness, brutality by community members or police officers or jail and prison guards, prison torture (including long-term solitary confinement) or wrongful death, especially under the color of law. Other acts of discrimination will be considered, such as the government's neglect to provide timely, appropriate psychiatric services or adequate special education services, as well as housing discrimination.

Despite the illegal interference, this matter will go before to the International Court in 2015. Mentally ill people and drug/alcohol addicts who are poor or middle class deserve treatment, not torturous incarceration in long-term solitary confinement, denied visits and phone calls sometimes for years. We, the families and next friends of mentally ill people in the USA, will demand restitution for negligence, police brutality, prisoner torture, and wrongful deaths in the United Nations and request that body to mandate appropriate changes in the United States to respect the human rights of mentally ill persons, drug/alcohol dependent people, and their families. U.S. to U.N.: What Prisoner Torture?


Families of mentally ill American inmates were astounded to read the headline below in Solitary Watch.com: U.S. Government Tells UN Committee on Torture: “There Is No Systematic Use of Solitary Confinement in the United States” 

I published the following comment at the article: 
With so many super max prisons and solitary jail/prison cells in the USA, it is surprising that the USA would deny its systemic use of solitary confinement. It is estimated that roughly 80,000 inmates are in solitary confinement, some for decades. Over 60 percent of the isolated inmates are mentally ill people who should be treated as psychiatric inpatients or outpatients, not punished for offenses that arose from their health disabilities. Assistance to the Incarcerated Mentally Ill (AIMI) plans to file an action in International Court against the USA for long-term homelessness, brutality and wrongful deaths of mentally ill Americans, especially mentally ill inmates who were denied timely psychiatric treatment to prevent offenses that led to harsh punishment. Torturous solitary confinement and denial of visits are two of the most common complaints among family members of mentally ill inmates. According to Solitary Watch, the USA plans to deny systemic use of solitary confinement in its report to the United Nations and claim that American citizens are protected by the U.S. Constitution from such cruel and unusual punishment. The report says in part:
The United Nations Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT) forbids “any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person” for the purposes of intimidation, coercion, forced confession, or punishment, “when such pain or suffering is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity.” The United States asserts that it is in all cases in alignment with CAT. See the "protections" that Americans allegedly have:

The U.S. Constitution, along with federal and state laws, establishes standards of care to which all inmates are entitled…U.S. courts have interpreted the Eighth and Fourteenth Amendments of the U.S. Constitution as prohibiting the use of solitary confinement under certain circumstances, especially with regard to inmates with serious mental illness or for juvenile detainees. (Specifically, under the Eighth Amendment’s prohibition against “cruel and unusual punishments,” correctional facility administrators may not subject inmates to solitary confinement with deliberate indifference to the resulting serious harms, including suicides, suicide attempts, and serious self-injury. See Farmer v. Brennan, 511 U.S. 825, 843 (1970); see also, e.g., Madrid v. Gomez, 889 F. Supp. 1146, 1265 (N.D. Cal. 1995) (using prolonged solitary confinement on prisoners with serious mental illness can be “the mental equivalent of putting an asthmatic in a place with little air to breathe”) …

People with mental, physical, and psychological disabilities are not punished with solitary confinement, the U.S. report asserts:

The Americans with Disabilities Act of 1990 (ADA) and the Rehabilitation Act of 1973 (Rehabilitation Act) restrict and regulate the use of solitary confinement for persons with disabilities. Title II of the ADA, 42 U.S.C. 12132, applies to state actors, while the Rehabilitation Act applies to federal correctional facilities and correctional facilities receiving funds from the federal government. Both statutes prohibit the use of solitary confinement in a manner that discriminates on the basis of disability instead of making reasonable modifications to provide persons with disabilities access to services, programs, and activities, including mental health services. See Pa. Dep’t of Corr. v. Yeskey, 524 U.S. 206, 210 (1998).

THE UGLY TRUTH:  In addition to solitary confinement being systemically used to contain mentally ill inmates, juveniles, and many other prisoners (including those who refuse to work free or nearly free), it is further used to force potentially innocent defendants into plea bargains with trials denied. This typically happens to African Americans. Black people, especially men, are sometimes denied their Sixth Amendment right to fair, speedy, public trials, represented by adequate defense counsel, i.e., Shannon Nyamodi of North Carolina (two years), Terrell Scott of Pennsylvania (five years), and Kalief Browder of New York (three years). Black mental patients regularly experience indefinite detention without trials, which is cruel and unusal punishment. Two unfortunate examples are Mississippi inmates Marktain Kilpatrick Simmons (eight years) and Lee Vernel Knight (seven years).

Numerous commentators at the Solitary Watch article are incredulous over the prospect of the U.S. State Department denying the “systematic use of solitary confinement” in American prisons. Eileen Siple wrote,"In many counties in the US, including Harford County, MD, juveniles charged as adults are automatically placed in solitary within adult jails and prisons “for their own protection”. This can go on for months or years – until they are bailed out, waived down (unlikely), turn 18, or their cases go to trial. Isn’t that systematic?"

How can the State Department deny systemic use of solitary confinement and other torture against American prisoners with evidence and witnesses to the contrary? For example, "Dog Justice for Mentally Ill" blog carries numerous reports and videos documenting brutality and deaths of mentally ill victims in custody, which were also published on mainstream news broadcasts.The denial of systemic prison torture may be possible because a minute percentage of human rights complaints the United Nations receives originate in the United States. In "AIMI vs. the USA," the International Court will be presented with evidence that police and correction officers' often torture, brutalize and sometimes kill mentally ill Americans without incurring criminal charges. Cover-ups are more likely to follow such abuses and deaths. In addition, cruel and degrading treatment against prisoners frequently extends to family members and advocates who demand justice. Following the secret arrest and wrongful death of Larry Neal, this writer's disabled brother who was a lifelong schizophrenic heart patient, his family endured censorship, surveillance, and financial persecution for requesting an explanation about his kidnapping and murder in Memphis Shelby County Jail in 2003. Retaliation for exposing crimes against humanity in America's justice system is common, but human rights advocates must not be deterred. "Silence is the deadliest weapon of mass destruction." ~ Cynthia Mckinney

Maitri Klinkosum Blocks Nyamodi Trial


Elizabeth Crudup discusses her son, Shannon Nyamodi, 19, who has been wrongly incarcerated in Franklin County Jail since August 16, 2012. He was charged with robbery and attempted murder on a Caucasian woman who he actually helped after a white youth allegedly shot her. Even the victim denies that Shannon is her assailant, but Shannon was arrested and is being held in solitary confinement torture to FORCE a plea deal. His attorney is apparently his worst enemy. Rhonda McClean was shot in the face at point blank range and robbed of nearly $65,000.00 on August 16, 2013. Shannon heard her screaming for help and rendered aid. Later the same day, he and his family were surprised that Shannon was arrested for the crime. Donald James “DJ” Chalk posted the picture below wherein he is surrounded by cash on his Facebook wall the next day. The defense attorney is apparently double-crossing this family. Shannon's family raised a substantial fee and retained the defense attorney, who is a former prosecutor: MAITRI (MIKE) KLINKOSUM. He seems to be working with the prosecution instead of working for his client. He tries to get Shannon to take a plea deal instead of motioning for a bond reduction and a speedy trial on these trumped up charges. Shannon is apparently denied a trial because his attorney wants Shannon to lie on himself. Klinkosum requests a continuance in the pleading below, saying he is too involved in another case. Meanwhile, Shannon has been jailed under torturous conditions for nearly two years awaiting trial.

“Segregation, isolation, separation, cellular, lockdown, Supermax, the hole, Secure Housing Unit … whatever the name, solitary confinement should be banned by States as a punishment or extortion technique,” UN Special Rapporteur on torture Juan E. Méndez told the General Assembly’s third committee, which deals with social, humanitarian and cultural affairs, saying the practice could amount to torture.

A University of Michigan neuroscientist suggested Friday that the physical impact on the brain could be just as significant if not moreso, and could “dramatically change the brain” in just a matter of days. Speaking on a panel about solitary confinement, neuroscientist Huda Akil said a number of other studies have documented how each of the factors involved in solitary confinement change the physical shape of the brain.

When Shannon and his aunt tried to fire Klinkosum, he allegedly threatened Shannon's family. Klinkosum allegedly swore to them on separate occasions that if he is fired, he will work with the prosecutor to get Shannon jailed for 30 years. They are foreign-born women, and Crudup's sister may not know that is illegal. A Bar complaint has been filed. The family will try to get this man off the case so that a public defender can be appointed. Of course, they would prefer a private attorney, but Shannon's family paid Klinkosum a SIGNIFICANT amount of money for Shannon's defense and exhausted their funds. 

The Sixth Amendment to the United States Constitution guarantees all citizens a speedy, public trial with adequate defense. Shannon does not deserve to have his case in the hands of a man who allegedly threatened his family and his freedom and has been instrumental in lengthening Shannon's incarceration by filing motion(s) for continuance. Shannon's court docket will reveal how many times this has happened. In another case this writer covered, a defense attorney and prosecutor in Pennsylvania took turns refusing trial until the defendant, Terrell Scott, a mentally ill black youth, remained incarcerated without any conviction for 4.5 years. Scott, who retained permanent injuries from beatings, finally plea bargained when it appeared he would continue to be indefinitely detained and denied trial. It is a serious conflict of interest for defense attorneys, prosecutors, judges and lawmakers to own prison investments.

Solitary confinement, which causes mental illness in some inmates, is apparently intended to make Nyamodi desperate enough to plea bargain on the false charges. 

Indefinite detention and cruel solitary confinement must not be allowed to force defendants in America into false confessions. Stand for the Sixth Amendment.

Shannon Nyamodi Tortured with Solitary Confinement to Force a Confession in Franklin County, NC

Solitary confinement is known to cause mental illness. It is being used in Franklin County, NC to force a confession from an innocent black youth who has been imprisoned for a year without trial for a crime that even his alleged victim said he did not do. TORTURE, CORRUPTION, AND RACISM IN FRANKLIN COUNTY, NC JUSTiCE SYSTEM ~ Franklin County Jail in NC prevents Shannon Nyamodi from receiving visitors and phone calls. He is under a GAG ORDER that is likely imposed without a court order. Shannon is the black youth who helped a Caucasian woman when she was shot and was then charged for being the shooter because he was the only black man in the vicinity. His mother Elizabeth Crudup interviewed with "Human Rights for Prisoners March," my blogtalkradio show produced by NNIA and Dr. Floyd Harris Jr. Shannon's story went viral on the Internet. But Elizabeth Crudup has NOT been allowed to see her son to let him know that YOU know and YOU care about his being imprisoned a year without trial. The Franklin County Jail hurrdied and put Shannon Nyamodi in SOLITARY CONFINEMENT to tighten the screws and make the innocent youth sign a plea deal for a crime that even the victim said he did not do. Furthermore, Franklin County REFUSED at first to accept a Writ of Habeas Corpus for Shannon. This is something his attorney should have filed long ago if he were not a part of this railroading that is being done against a black youth, but after having received $30,000 from the family, the defense attorney turned his back on Shannon Nyamodi and does nothing to end his client's indefinite detention without a trial. This has continued for a year.

Now there is a Facebook page that is represented as being by the woman Shannon helped. Her daughter is in jail, sentenced for 2 years for working with other parties to have her mother shot. Both she band her daughter signed statements saying that SHANNON NYAMODI has nothing to do with this and was an innocent bystander who came to the woman's aid. Whomever put that Facebook page up misspelled the victim's name and seems to be trying to withdraw the victim's testimony that was in Shannon's favor. Could it be the sheriff has paid somebody to put up a Facebook page representing the victim? Have authorities promised an early release to the victim's daughter if they CHANGE their testimony and lie on Shannon? The victim said repeatedly on all records when she was initially shot that Shannon was not her shooter, but the corrupt Southern system seems to be trying to MAKE her change her testimony and keep Shannon Nyamodi in solitary confinement until they run the teen crazy to enforce him to lie on himself. Ms. Crudup said the real shooter is related to Franklin County's sheriff.

Ms. Elizabeth Crudup said she has been writing to me about Shannon being held in solitary confinement on Facebook as comments to my articles and posts about Shannon, but i did not see her comments. Internet companies can have fake views - what you see when you post is not necessarily seen by anyone other than you. Whether this is done BY the Internet companies or by NSA, I cannot say. I know this is true and have films to prove it. I typed using two computers and was signed in as myself on one computer but not the other. I entered data as myself. On the other computer I viewed my page and did not see the data that should be there. Herman Wallace Re-indicted Before Dying

Katherine Conner is a Katrina victim who was swindled by a unlicensed contractor from Mississippi with whom she contracted for home repairs. She cancelled a check she wrote to the contractor that was $3,500 more than the contract amount for home repairs that are still not finished. She expected the contractor to give her a correct bill. Instead of receiving justice, Katherine was indicted for theft of services and required to pay 70% of her income each month in probation fees and restitution. Over the course of time, Katherine got behind in her court-ordered payments and was told that she had until June 2013 to either pay $3,000 in overdue fees or face three years of hard labor in prison. Katherine received some donations toward her probation and borrowed the rest. Now she struggles to pay her monthly probation and restitution fees PLUS repay her loan. Katherine complained about her civil matter with the contractor being treated like a criminal matter, and she feels her teenage son was targeted for wrongful prosecution as a result.

Life is extremely challenging for Katherine Conner and her son, Matthew Moore. Meanwhile, their prosecutor continues to wreck havoc on the lives of black people in Louisiana. District Attorney Sam D’Aquilla had Herman Wallace re-indicted for murder a few days after he was released from 41 years of solitary confinement in Angola Prison. Wallace, one of the Angola 3, probably died immediately upon hearing the news in hospice care that he was due back in court in December 2013.

“I say he is a murderer, and he is not innocent,” District Attorney Sam D’Aquilla said. “The conviction was overturned because the federal judge perceived a flaw in the indictment — not his murder conviction.”

D’Aquilla said Wallace's attorney Nicholas J. Trenticosta, of New Orleans, was wrong when he said Tuesday that Wallace is “a free man, and he’s innocent.”

2012 Human Rights for Prisoners March

Paragraph 1 of 9 -- Activists plan a HUMAN RIGHTS FOR PRISONERS MARCH across America in October 2012. It will be conducted in the same way that the Olympic torch is passed, using a banner instead of a torch. Advocates will meet with other relay walkers at their city line and march the "HUMAN RIGHTS FOR PRISONERS" banner through their city to the next city line to pass the banner. MASS INCARCERATION MUST END! Instead of reducing our prison rolls, officials now plan concentration camps in the USA. It is time to take the battle offline and to the streets.



Paragraph 2 of 9 -- If you don't care about prisoners, consider this: YOUR JOBS WENT TO PRISON along with 2.3 million people (url # 1 of 3 http://www.nytimes.com/2012/03/15/business/private-businesses-fight-federal-prisons-for-contracts.html?pagewanted=all . Roughly one million prison laborers work in customer service, manufacturing, and perform many former union jobs. Private industries in America cannot compete with prisons and overseas corporations for providing cheap production costs. End mass incarceration.

 Paragraph 3 of 9 -- The weather throughout the nation is usually mild in October, which is the last month before Election Day 2012. We hope to impress upon local and federal candidates that people are FED UP ENOUGH TO STAND UP against mass incarceration, wrongful convictions, prisoner abuse, capital punishment (especially without irrefutable proof of guilt), excessive sentencing, criminalizing mental illness, private prisons, inadequate health care for inmates, solitary confinement torture, substandard meals for prisoners, exploitative prices for phone calls, prison work projects that compete with companies that hire "free" people, brutality and covered-up murders by police and prison guards, and other inhumane acts.

Paragraph 4 of 9 -- Our banner will say "END MASS INCARCERATION" on one side and "HUMAN RIGHTS FOR PRISONERS" on the other side. Please sign up in the comments section below to carry the sign though your city to the next city line to relay it to advocates who will be waiting for it there. You can use your first name, whole name, or a pseudonym. Name your city, and include a means of contact - a phone number or an email address. If you prefer not to use your regular email address, please open a new email account for coordinating this effort. No one will have to leave home and attend a rally in another area, but our demands will be carried throughout the nation. We will likely use four or more banners so that most cities can be represented within the month of October from East to the West. The HUMAN RIGHTS FOR PRISONERS banners will be 5 feet long and 2.5 feet wide so they can be carried by two walkers without the need to leave public sidewalks. The banners will be plastic to resist rain.

Paragraph 5 of 9 -- Please check with authorities in your area for any regulations regarding the march through your town. In Atlanta, I was told that signs cannot have sticks, and the banner against MASS INCARCERATION and inhumane conditions for prisoners in America will not be on sticks. If you plan to have a rally in your city in association with this effort to STOP PRISONER ABUSE and END CORRUPTION IN THE JUSTICE SYSTEM, please make sure you have any necessary permits.

Paragraph 6 of 9 --  INMATES ARE DYING of murders, suicides, and hunger strikes! STAND UP for justice and compassion. 4.   In my family's experience, if Babar Ahmad is abused or murdered in U.S. prisons, the United States Department of Justice will help the facility cover-up the crime. That is what happened to my brother, Larry Neal, a 54 year old lifelong schizophrenic heart patient who was killed in Memphis Shelby County Jail in 2003. An elaborate cover-up that continues today ensured immediately after his murder. The murder cover-up was engineered with help from The (Johnnie) Cochran Firm, which pretended to be Larry's family's wrongful death attorneys but actually held his case secretly inactive until Tennessee's statute of limitations was at its end. Then the USDOJ allowed the jail to enter fraudulent reports into federal records regarding the period when the USDOJ was in overview of the jail following lawsuit by the USA for inmate abuse: the jail apparently omitted reporting Larry's death.

5.   Unfortunately, 60% of inmates in solitary confinement in America are mentally ill people who should be in treatment as hospital inpatients or outpatients, not suffering torture for months or years (some for decades) in lonely 6 foot by 9 foot containment cells, naked to prevent self-injury, and sleeping on cold, bare concrete slabs or iron bed rails. Larry was secretly arrested, then held 18 days while the jail denied having him arrested to prevent his access to vital heart medication. The harmless disabled American was killed under circumstances that neither the jail nor the United States Department of Justice will disclose. I live essentially under house arrest, surrounded by stalkers who take over my home computer and follow me wherever I go to ensure I do not access any computer they have no direct control over. This is done to impede my Internet reports about Larry's secret murder and inhumane treatment to 1.25 million other mentally ill inmates in the U.S.A. and mentally ill people killed during lunacy arrests.

6.   Preventing my reports is likely done by/for prison investors who wish to have more mentally ill people imprisoned for inappropriate behavior caused by their common, treatable health conditions. The illegal censorship and stalking is condoned by federal and local justice officials. See what parts of my text the stalkers coded to appear in small print below in paragraph number ten below: Up to four agents go online with me whenever I do, but police were ordered to ignore my police reports and refuse to uphold my First Amendment rights under U.S. Code and Georgia State law. I mailed Eric Holder and Georgia officials the stalkers' IP addresses my computer security system captured after police refused to investigate and prosecute the crimes, but none of them responded. This is how far the authorities will go to hide the murder of a handicapped American in custody. 7.  If a prison guard has compassion on those international inmates and reports their abuse, if they are abused or killed, the guard might also be gangstalked, persecuted with poverty, and find his phones and computers are taken over by stalkers to prevent him from communicating with the public about the crimes against humanity, which is what I experience. According to my stalkers, it is too late to save America from fascism. If it were too late to save America from fascism, Nazis would not work so hard to censor the truth about crimes against humanity that happen here. Make no mistake: Babar Ahmad and the other three terror suspects will be in danger in American prisons, just as 2.3 million Americans are already, especially since they are minority people and if any of them become mentally ill as a result of the stress they must feel. A 180-pound mentally ill Latino youth was arrested in a Utah private jail last October and emerged in February, four months later, as a 77-pound corpse. Prisoners in Georgia went on a nonviolent work strike in December 2010. During that period, my stalkers immediately removed 11,000 of my tweets from Twitter, where I am Koffietime, lest the public Google "human rights for prisoners" and read about my brother's murder. I wrote a poem about the prisoner strike, during which prisoners were brutalized and some went "missing." Georgia prisoners said they were so hungry they did not know what else to do! Inmates are made to work for major corporations and government agencies that seek to save money by using prison labor instead of hiring "free people," especially at union scale. 8.     Yes, I would be surprised if  Babar Ahmad and three other terror suspects are not waterboarded and otherwise tortured in American prisons. That may be how my brother Larry Neal was murdered - as practice for enhanced interrogation specialists. Other black mentally ill Americans have also gone missing after police custody and turned up months or a year later dead as door nails. Maybe they are being used for medical experiments like blacks were during the Tuskegee Experiments. Furthermore, U.S. prisons do not seem to have any evacuation plan for events like Irene. The prisoners at Rikers Island were left to perish in the storm in 2011 while much of New York was evacuated. 


9.     As I said, authorities REFUSE to say how they killed poor Larry Neal. Blacks are shot all the time in America by police officers, so it must be something much worse that officials are hiding by denying Larry's family any explanation or records in defiance of the Freedom of Information Act requests and federal subpoena. Pray for Americans, and try to keep Ahmad and others someplace safer where they might not go hungry or suffer violence that would be covered-up. Some of my tweets are attacked and disallowed from reaching addressees.
