Network groups are very useful for uniting people who work together for a common goal. I have joined many groups, although I am not permitted any longer to send mass emails to the African American and prisoner activists groups I joined at YahooGroups. Cyberstalkers nearly always kick me offline when I try to do so. That started last spring after I announced the Human Rights for Prisoners March, which was planned for May 16 in Atlanta. As it happens, there were thunderstorms that day and the march was canceled. See information about it online and what I consider to be 26 main justice concerns - "Human Rights For Prisoners March." It is hopeful to see that some of those concerns are being addressed by lawmakers who recognize the urgent need for change. Many bills are pending before the 111th Congress that would help regarding justice, and some have already passed. Judges are also effecting positive changes. More defendants are being remanded to drug court and mental health court now, and death sentences are down to 1976 levels. In fact, Judge Kevin Fine (USDC, TX) recently pronounced capital punishment as being unconstitutional. That was a major step forward in the state that leads the Union in executions - over 400 since capital punishment was re-instated in the 1970's and over 200 under Texas' present governor.
As you probably know, I am a human rights advocate. Our group members at Assistance to the Incarcerated Mentally Ill, founded after the denial of justice following Larry Neal's murder, try to help victims have a voice regardless of their race, religion, or ethnicity. In fact, I was late coming to realize the level of prejudice that exists in America and how much it impacts our lives on nearly every level. I believe that classism is also a major problem in America. A white person who lacks wealth is subject to discrimination in the justice system like Africans are, although at a much reduced ratio - nowhere near the 1 in 9 rate of imprisonment that young African males reportedly have. Although being white reduces the likelihood of being arrested, it seems not to help people who get caught up in the system. For example, in August 2009, a man named Thomas Arthur was about to be executed in Alabama although results from Arthur's DNA test that the forensic lab released in July reported Arthur was no match for the crime scene evidence that was tested. Judge Pulliam sealed the results of Arthur's DNA test, and prosecutors planned to ask for Arthur's death warrant in August. Apparently, the public was not intended to know about Arthur's wrongful execution until years later, like in the Cameron Scott Willingham case (another white man who was executed in 2004 for murdering his children, but information released recently indicates he was innocent). Mainstream news was quiet about the results of Arthur's DNA test, which he had been denied until 2009 after 26 years of imprisonment for a murder it appears Arthur did not do. Fearing that Arthur might be wrongly executed, I worked all night against cyberstalkers on August 31 to alert people about the inmate's predicament.
It is going to take unity among oppressed people to accomplish justice reform. I work as hard to save Thomas Arthur and Jeff Wood, white men, as I do for Troy Davis and Darrell Lomax, wrongly convicted Africans. Now Thomas Arthur is going to get a hearing "before execution" I read. That sounds like the hearing is only a formality. Hopefully, I am wrong about that. I learned this week that my Twitter tweets may be going to some set-aside area. None of my tweets to save Troy Davis or Hank Skinner, who is scheduled for execution on 3/24/10 in Texas, appear to be registering with the regular tweets. I did a search for both men's names at Twitter's "real time tweets" field on the log-in page, and NONE of mine for those two men showed up although I have tweeted about little else lately. Last night when I conducted a search at Twitter's "real time tweets" field for Troy Davis' name, I got a response from Twitter saying, "NO RESULTS FOR TROY DAVIS." I cannot tell whether that response really came from Twitter or from the cyberdogs who illegally put my computer on their Intranet in order to monitor and control my use of the Internet. I hope they are not trying to tell me something. We all want good results for Troy. We want justice.

If it were not for people helping by re-publishing articles, AIMI could not be effective promoting HUMAN RIGHTS FOR PRISONERS. Although every justice issue is important, we mainly use online services to help decriminalize mental illness and end capital punishment. Roughly 1.25 million mentally ill people are prisoners like my unfortunate brother Larry Neal was when he was murdered under secret arrest in 2003 in Memphis/Shelby County Jail. AIMI members support H.R. 619, a bill by Representative Eddie Johnson (D-TX 30) to resume Medicaid funding for inpatient treatment in hospitals. Passing that health care bill would create an alternative to imprisoning people for having a common, treatable health condition - mental illness. Mentally ill people, whether black, white, or other, are probably the most discriminated-against people in America. If they have the triple distinction of being a minority person, poor, and mentally ill, they can actually be murdered behind bars like my brother Larry was, and the USDOJ will refuse to investigate their deaths. Pit bulls get more respect.

Please help promote H.R. 619, which was also endorsed by NAMI and other mental health organizations. Mentally ill people should be treated in hospitals and not imprisoned for being sick. Also, help protest the execution of Hank Skinner, who I understand was a prisoner activist before his conviction. Some people believe that is why Skinner is scheduled to die in Texas on March 24, 2010, and is deprived of DNA tests to prove his innocence. Since I have been gangstalked and intimidated for asking WHAT HAPPENED TO LARRY NEAL and advocating for justice reform, it is easy for me to believe that about Skinner's impending execution. Jail, the county D.A.'s office, Tennessee Governor's office, and the USDOJ. The Constitution, Bill of Rights, and U.S. Code are ignored. Deaths by police and secret deaths and abuses of inmates in county jails and U.S. prisons (particularly of African American handicapped persons) are deemed less worthy of investigation than dog abuse. With over 2.3 million people incarcerated in the U.S., persons should be free to speak and write in favor of inmates' humane treatment without retaliation, especially regarding one's own handicapped relatives.

I write about THE COCHRAN FIRM FRAUD. An Alabama law firm partnered with Johnnie Cochran shortly before he became terminally ill and died in 2005. They use his name contract with and defraud clients, who are mostly minority, disenfranchised persons. In our case, The Cochran Firm protected Memphis Shelby County Jail from our lawsuit for Larry's wrongful death. The law firm simply never filed the lawsuit.Because I expose The Cochan Firm Fraud and other injustices, I am followed and accosted at neighbood businesses but denied police 911 emergency services. Affidavits from witnesses are in Neals v. The Cochran Firm, USDC, Northern Dist. of GA. More witness testimony was ready for presentation in court, but the case was dismissed without jury trial. The judge ruled that what The Cochran Firm did in defrauding our family to protect the jail, our intended defendants, was "immaterial." That is likely because African American taxpayers are considered "immaterial." In fact, in this elitist society, I found that middle-class and poor white people are also "immaterial" enough to die on execution tables while denied DNA tests to prove innocence and to have their most vulnerable family members (mental patients) locked away in prisons.

In August, the DOJ said it is not telling us anything. Apparently, transparency in government does not apply when citizens die in secret government custody in America.

My online submissions are regularly attacked by cyberstalkers, deleted from the Internet, pictures and comments removed from articles, and more. My emails are also attacked. They are monitored and deleted at will, before or after I read them. At least one round of emails were changed even after some of the recipients had read them. There are printouts and witnesses. Yahoo announced that it bounced over 2,000 emails intended for my receipt within two months (since mid-April), when I announced plans to organize a march to support prison reform as proposed by Sen. Jim Webb (VA-D), who introduced The National Criminal Justice Act of 2009, calling for a national commission to "undertake a top-to-bottom review of our entire criminal justice system." I did not know initially how much corruption was involved in my brother's death and the conspiracy that would come against our attempts to get legal recourse and advocate for fairness in the justice system. Otherwise, I would not have written my articles advocating for justice for Larry and other inmates in so-called "independent" news sites. I did not know initially how much corruption was involved in my brother's death and the conspiracy that would come against our attempts to get legal recourse and advocate for fairness in the justice system. Otherwise, I would not have written my articles advocating for justice for Larry and other inmates in so-called "independent" news sites. I would have taken a computer tech course and only used my own website. (However, I discovered recently they cybercensor it, also and can render pages or parts of pages invisible to the public.)
It is disturbing to see the censorship applied to my work. Cyberstalkers are hired to remove my articles, switch taglines on my work, and otherwise impede the spread of information about my brother's secret death UNTIL WHAT? Do they intend to pay cyberstalkers to clean up after my work forever, or just until they can catch me alone at the store? I pray, others pray for my family and me, and I continue to write about injustices, because there are many other victims. Yes, I report horrible injustices. During census counts a few years ago, each slave counted for 1/4 a human being. With the recession, Africans apparently digressed in human value. Larry was both African American and mentally ill, so pit bulls have more clout than he did. Many people, black and white, need DOG JUSTICE in America. After I learned that I lived in a place where mentally and physically handicapped citizens like Larry Neal could be secretly arrested and murdered and not given the investigative and prosecutorial effort of dog abuse cases, I began to research why such a thing could happen. All notices and requests to the police, FBI, USDOJ, and the courts for relief from the cyberterrorism, censorship, and in-person stalking have been met with no responsive action whatsoever, just as our request for records from the USDOJ under the Freedom of Information Act has not been met with the release of records, despite promises from the USDOJ that response would be had before the end of June 2009. In August, the DOJ said it is not telling us anything. Apparently, transparency in government does not apply when citizens die in secret government custody in America.

Larry Neal's death while under secret incarceration and his wrongful death attorneys' fraud to help the jail escape accountability should be met with due process of law. Freedom of press should not be extended only to those who say "All is right with the world" and "The King has on a beautiful robe."

African Americans and Christians First?

There are conspiracies that are not theoretical, but certified. The secret arrest and wrongful death of Larry Neal cover-up is an ongoing conspiracy. As the world turns, I learn about other crimes that are interconnected with my brother's murder cover-up. I really do believe we can do better than homelessness, prison and death for mentally challenged Americans. We can begin by passing H.R. 619 for Medicaid funding for mental hospitalization. If decision makers institute assisted outpatient treatment programs (AOTs) like Kendra's Law for subsistence assistance and mandate psychiatric treatment for acute patients who are discharged from hospitals and prisons plus pass H.R. 619 to increase the nation's psychiatric hospital beds, the nation would completely decriminalize mental illness. But that is not something that everyone wants.
@Twitter @Google Whenever I'm not really on Twitter but stalkers' network, I can't retweet. That's a good test for censored ppl to use - That tweet just sat in my Twitter input field. I discovered that easy method to tell when I am on my cyberstalkers' network as opposed to really being at Twitter. I think it is important to pass such tips along to My Fellow Americans so that you can easily recognize when you are also illegally taken off Internet and put on a censorship team's Intranet. It may never happen unless the government wants to hide the murder of one of your close relatives or you advocate for human rights for prisoners - including prison release for half the inmate population. I am director of Assistance to the Incarcerated Mentally Ill ("AIMI"), advocating to decriminalize mental illness. That online advocacy began after Larry's murder and our realization that 1.25 million other mentally ill Americans like Larry are cruelly imprisoned rather than treated in hospitals or community care programs.

Congratulations to Judge Kevin Fine of USDC 177th Dist., Houston, Texas. Judge Fine declared the death penalty unconstitutional. He had the courage to do so in the state that leads the Union in executions. Hopefully, Judge Fine realizes that our "authoratives" (no, I did not mean "authorities") engage in many unconstitutional activities all the time, and killing people is probably a favorite. Although condemned men are executed at a brisk rate in Texas and other mostly Southern states for murders, proved or unproved, the authoratives flat refuse to answer how they murdered Larry Neal, a harmless, lifelong schizophrenic heart patient who aggravated police with his loud singing and occasional panhandling on the streets of Memphis. Forbes recently pronounced Memphis the third most miserable city in the USA, but Forbes owes an apology to the two cities that precede Memphis on its list.
I am cybercensored, persecuted, gangstalked, threatened, and endangered because I refuse to join in the cover-up regarding my brother's murder by withholding further reports to We the People regarding his secret arrest and death. I am punished for not being like mainstream media and simply ignore the fact that after Larry's death when we sued The Cochran Firm for defrauding Larry's family to protect the jail, The Cochran Firm was allowed by the court to disclaim having a Georgia office (that is where our lawsuit was served). That is the basis under which our lawsuit was dismissed by Georgia Superior Court (superior to all African Americans and all mentally ill people and their families). One conspiracy leads to another when it comes to hiding murders. The flagrant violations against my Constitutional rights that are done to hide Larry's murder cover-up are probably atypical. Whenever possible, authoratives get around direct attacks against citizens' rights by enacting laws that supercede the rights that Americans supposedly have. For instance, in one of my illegally censored articles this week I reported that Georgia legislators enacted a law in 2006 that erased the right to trial by jury for crime victims and their survivors. Police officers or rich, well-connected Georgians can possibly kill citizens, be indicted for murder, then the presiding judge can dismiss their murder charges without jury trials. Whether such cases proceed to jury trial is up to the judge's discretion as long as the defendants plead self-defense like most police officers do when they shoot citizens. That law disposes of the right to trial by jury for victims. I learned about it when the murder charges against an officer were dismissed without jury trial this week in the 2002 shooting death of an African American teen, Corey Ward. That particular article is probably censored heavily because I mentioned the Troy Davis case and described my family's commonality with him regarding Georgia courts' refusal to grant jury trials in certain cases - especially when one has an abundance of evidence and authoratives do not wish for the plaintiff or defendant (whichever the case may be) to win. That brings us to another tweet I had trouble posting yesterday. It shows up on my profile page at Twitter now, but I will have to check with my followers to see if they actually saw it post. I never saw it post on my "home" page view. I wrote:

For about an hour on March 5, I was actually on Twitter. I could see tweets by people I follow posting rapidly. It was an amazing sight. Ordinarily, I only see my own. And some of my own tweets do not actually show on my home page view, like the one above, but they appear on my profile page view. Are they also skipping the "home" view for my followers? Cyberstalking would probably make more sense if people did not have video cameras to record illegal First Amendment attacks on citizens who only want to get accountability for their relatives' deaths in secret government custody.
I never would have thought I had the right to peacefully assemble online with other people and advocate for the government to stop discriminating against mentally ill people like Larry if authoratives had not decreed that my classmates and I say the Pledge of Allegiance every morning. That message of freedom being indoctrinated into people who are intended to be slaves is counterproductive to authoratives' ultimate goal, although it is undoubtedly useful to instill the fallacy of "inclusion" into all citizens to keep us paying taxes and sending sons and daughters marching off to wars (supposedly to protect human rights in foreign lands). Freedom of assembly is another of the rights that members of Assistance to the Incarcerated Mentally Ill are denied by censorship. People cannot assemble online if their emails do not get past their kitchen ceilings and articles they write are deleted or blacked out in parts, or if their links are disconnected from the material they are supposed to link to, can they? I wrote two articles about the Troy Davis case this week, so the censorship force and my family's gangstalkers went crazy on my street. After I escaped a USDOT truck on September 27, 2008, and mostly stayed home for safety since, NEW neighbors moved in across the street from our home, and a USDOT truck made deliveries there - an 18-wheeler. They probably want us to know who they are and why they came. If you have neighbors the DOT helped to move in, let me know and put our minds at ease, please. Incidentally, most co-sponsors for H.R.645 are on the Transportation Committee in Congress. Railroad improvements are planned, which I do not find surprising in the least.

I received notice that I have even been whitelisted for asking WHAT HAPPENED TO LARRY NEAL and requesting that acute mental patients like Larry be treated in hospitals and community care programs rather than relegated to 9' x 6' isolation cells for months or years, naked, sick, and imprisoned. As dangerous as it seems to be to disappoint the authoratives, I must obey my Father. He said we will be judged by how we treat the least of these, His brethren. Matthew 25:36 specifically refers to sick, naked prisoners. Other inmates have orange jumpsuits, I BELIEVE.

The flagrant violations against my Constitutional rights that are done to hide Larry's murder cover-up are probably atypical. It is gratifying to see that mentally challenged people and their relatives and next friends are finally beginning to understand that Americans with mental disabilities are discriminated against by withholding treatment and support that people with physical disabilities have. Psychiatric patients must stop being preserved in their untreated states to boost prison rolls. Ohio inmates filed a class action lawsuit. I hope it is only the beginning. God said, "Let my people go." I remind authoratives of that through the microphone on my PC, which they illegally use to listen into my home. Six FEMA centers are proposed to be erected in the U.S. for Americans in H.R.645 (a Congressional bill introduced on January 22, 2009, by Alcee Hastings, a black former federal judge who was ousted for corruption before going to Congress), I think African Americans and Christians will go first. I wrote two articles about the Troy Davis case this week, so the censorship force and my family's gangstalkers went crazy on my street. After I escaped a USDOT truck on September 27, 2008, and mostly stayed home for safety since, NEW neighbors moved in across the street from our home, and a USDOT truck made deliveries there - an 18-wheeler. They probably want us to know who they are and why they came. If you have neighbors the DOT helped to move in, let me know and put our minds at ease, please. Incidentally, most co-sponsors for H.R.645 are on the Transportation Committee in Congress. Railroad improvements are planned, which I do not find surprising in the least.

Authoratives have evidently decided that I am completely out of line to expect records and accountability for Larry's secret arrest and murder. They are apparently so prejudice against Americans with mental disabilities that they cannot concieve of why Larry's death should matter to his family. Perhaps they expected a thank-you note or a check, like a vet who puts down a pet. I received notice that I have even been whitelisted for asking WHAT HAPPENED TO LARRY NEAL and requesting that acute mental patients like Larry be treated in hospitals and community care programs rather than relegated to 9' x 6' isolation cells for months or years, naked, sick, and imprisoned. As dangerous as it seems to be to disappoint the authoratives, I must obey my Father. He said we will be judged by how we treat the least of these, His brethren. Matthew 25:36 specifically refers to sick, naked prisoners. Other inmates have orange jumpsuits, I BELIEVE.

Elite Integration - Mary Neal's Response to Dr. Watkins re: BCC
Dr. Boyce Watkins wrote an article decrying the disappointing representation the African American community receives from African Americans in public office. Below is my response. PLEASE NOTE that the congressional bill this article promotes, H.R.619, is moot now. It died in committee in February 2011. That happened because the media censored the bill, and censorship was used against individuals' attempts to notify the public that a bill was available to reinstate Medicaid for inpatient psychiatric treatment. Conscious people should still contact their representatives and support the concept of treatment replacing punishment for mentally challenged people, but H.R.619 is no longer available to promote specifically.

Unfortunately, Dr. Watkins, the lack of responsiveness from African American officials in addressing the needs of ALL constituents (beginning with the ones who elected them) is old news to me. I knew years ago that there has been what I call "Elite Integration." I wrote a poem about elite integration and broadcast it on a Rev. Pinkney Blogtalk Radio Show in January. When an African American handicapped man can be secretly arrested and murdered in Memphis Shelby Co. Jail and authorities respond by covering the crime and allowing or facilitating gang stalking against his family for asking WHAT HAPPENED TO LARRY NEAL, we're already at rock bottom regarding accountability from leaders of all races. It is time for African Americans to stop voting along racial lines. WE should pay more attention to MLK's speeches - judge not by the color of one's skin, but by the content of his character. That is not an admonition to whites only, but to everyone. Most of those we send to be our public servants have no loyalty to us as fellow African Americans or as constituents. See these articles:

While America's black, white, Latino, Asian, and Native American populations engage in infighting, the nation's wealth is still held by the top 5% of the population, and the gulf between America's rich and poor people is wider now than it was when Dr. King and 250,000 others met in Washington for the Poor People's March in 1963. Not everyone is suffering from the economic downturn. In fact, it gives the prison industry a tremendous boost.

I urge all people, particularly African Americans, to call or write your elected officials and ask them to support H.R. 619, a bill by Rep. Eddie Johnson (D-TX 30) to resume Medicaid funding for inpatient psychiatric treatment. There are currently 1.25 million mentally ill people in prisons and jails throughout the country as a result of "de-institutionalizing" mental illness in the 1960's and 1970's. The sick inmates are people who lack the finances to afford treatment by a private psychiatrist in his/her office or hospitalization during crisis. Many mentally ill offenders have the added challenge of drug and alcohol addiction. They cannot afford drug rehabilitation in the Betty Ford Center or any other private facility. Every prison issue has significant impact on the black community, because 1 in 9 black men and boys under the age of 34 is presently incarcerated, and two-thirds of all inmates were sentenced for drugs or other non-violent offenses.
While many African Americans decry the depressed economy, the weakest among us endure more than foreclosed homes or lost wages. They are locked away in prison where 60% of those enduring solitary confinement torture are mentally ill. Americans of all races should realize that if the motivation behind the country's high incarceration rate is removed (private prisons), the economy would improve immediately. Many of the jobs that Americans think went to third world countries actually went behind prison walls and are done by inmate laborers (slaves). Furthermore, the suffocating prison budget would be reduced if decision makers' conflict of interest was removed. Revenue could be increased for education, job creation, and youth programs that prevent incarceration and recidivism.
I experience much cybercensorship and in-person stalking because I advocate for Human Rights for Prisoners and write articles to give Assistance to the Incarcerated Mentally Ill. The attacks against my advocacy are allowed by all authorities who have a sworn duty to protect my right to free speech and freedom of press. This is in large part because private prison investors earn significant revenue by "trans-institutionalizing" mentally ill people into their facilities. See an example of my cyberstalking at a YouTube video called "PRISON LABOR PROFITS." Indigent acute mental patients like my murdered brother, Larry Neal, only traded a hospital bed for a solitary prison cell. Larry was cared for in a state mental hospital for around 20 years after mumps went to his brain before puberty; then he was "freed." Private prison owners and investors mean to keep America's indigent mentally ill prison population behind bars and add to their numbers poor and middle-class veterans who transition home suffering from Post Traumatic Stress Disorder (PTSD) - after some tragedy that should have been avoided by using Assisted Outpatient Treatment programs and other community care options.
Dr. Watkins, if you wish to know where your elected officials' loyalties lie - with big business or their constituents - find out where they stand on H.R. 619 to amend Title XIX of the Social Secuity Act and resume Medicaid funding for inpatient psychiatric care. Passing that one bill would 1) be just and humane for mentally ill CITIZENS and other incarcerated sick people; 2) promote community safety; and 3) reduce the high prison budget. When mental illness among poor and middle-class people was shifted from the Department of Health to the Department of Corrections, approximately 10 million citizens were directly impacted (sick people and their relatives). The potential for crimes by untreated mental patients and higher taxes affect us all. With the advent of private prisons, the U.S. gained the largest prison rate of any nation in world history.
Dr. Watkins, African Americans in positions of trust are no more likely to deal fairly with constituents than any other officials. It is time for all people to lay aside prejudice and stop judging who to support for elected office based on skin color. Look at candidates' past voting history and service to their communities and really listen to their speeches. If you BELIEVE you have representatives who honor and protect Americans' constitutional rights, including the right to life, ask them this question: "WHAT HAPPENED TO LARRY NEAL?" Let me know how they answer, please. I have asked that question for six years of every official office, and even our Freedom of Information Act request to the United States Department of Justice is denied a response. Ignoring the government's legal obligation to give Larry Neal's family records and accountability for his murder and the cover-up that followed did not end when an African American became Attorney General. Larry's death continues to be denied the investigative and prosecutorial effort that dog abuse cases get. Righteousness is not determined by race.

BACKGROUND ON TROY DAVIS CASE

I AM ALARMED FOR JUSTICE when I have unusual amounts of trouble posting articles about particular inmates. It is ordinary for me to experience a certain amount of difficulty publishing anything to give Assistance to the Incarcerated Mentally Ill or help secure Human Rights for Prisoners, but I have an unusual amount of difficulty advocating for Troy Anthony Davis, a Georgia death row inmate. Troy Davis and I have many commonalities, and chief among them is that we both wish for a just day in a fair court. We are both gagged - censored. Although many people have strong feelings for or against Troy Davis, they may know little about what that led to his wrongful conviction. Below is a summary of events that led to Officer MacPhail's death and Troy Davis' conviction as his killer. Officer MacPhail was a hero. He died while attemtping to rescue a homeless man who might be mentally ill from someone who was harassing and threatening him. Officer MacPhail deserves to have daylight shed on his murder and the right person prosecuted for his death. Only a new trial for Troy Davis can do that. Anyone would think that because the murder victim was a police officer, officials would be even more careful than usual to ensure that the right person is punished. However, I have discovered that in Georgia, a well-connected attorney can get outcomes that defy decency, justice, and common sense. It is too bad Davis probably lacked the finances to hire an influential attorney like Sylvester Coles did.when the police first began their inquiry about the officer's murder.
ON AUGUST 19, 1989, MARK MacPHAIL, an off-duty policeman, was working as a security guard at a Burger King restaurant in Savannah, Georgia. The incident started when Sylvester “Redd” Coles began harassing a homeless man, Larry Young, for a beer while Troy Davis and others watched quietly from a distance. Coles verbally harassed and chased the homeless man to a nearby parking lot where MacPhail was working. Coles threatened the retreating homeless man by exclaiming: “You don’t know me. Don’t walk away from me. I’ll shoot you.” Davis and others silently followed the scuffle. The homeless man yelled for help and MacPhail responded and was shot dead with a .38 caliber weapon. The parking lot was dark and the scene was chaotic.
Coles initially lied about carrying the .38 caliber revolver, but later admitted to carrying it with him on the night of the murder. He claimed that it was lost when the police attempted to recover the gun for testing.
After the police swarmed his neighborhood looking for suspects, Redd Coles and his attorney approached the police to exonerate Coles and implicate Troy Davis. Before the police discovered Coles' lies, however, the police had issued an arrest warrant for Davis without corroborating any part of Coles’ story. After the warrant was issued, Davis’ picture was plastered on wanted posters and in the local Savannah media. Davis stated that Coles had shot MacPhail. The police search of Davis' house less than 24 hours after the shooting turned up no gun.
The police never searched Coles’ house for the murder weapon, never included Coles’ picture in witness photo spreads, and paraded Coles in front of four State witnesses as a mere bystander in a crime scene “reenactment.”

Keep in mind that there were other young men at the scene, also - not just Troy Davis and Sylvester Coles. Wikipedia describes the scene as being dark and chaotic.
Poor Troy. Not only did Troy not hurry and get an attorney before Officer MacPhail's body got cold like Coles did, but Troy had inadequate defense during a time of major budget cuts for public defenders. There was a severe shortage of personnel to investigate the capital murder charge and defend Davis. For instance, the appeals attorney Troy was assigned had 79 other cases she was trying to handle simultaneous to Troy's.
And how do you like that police investigation? That's not how they do it on television shows, is it? TV detectives corroborate everyone's story who is at the scene of a crime. They would be particularly careful to substantiate accounts by someone like Coles, who admitted to lying to police about having a .38, the type of gun that killed Officer MacPhail. TV cops would have searched Coles' property, and all the young men at the scene would have been suspects until they could be eliminated by evidence. Sherlock Holmes would not have limited his search to the home of the guy Coles and his attorney implicated. I suppose Savannah police don't watch enough Columbo.
Hopefully, the USDC judge who is charged by the U.S. Supreme Court to decide whether Davis will be allowed a new trial will decide that Officer MacPhail, Troy Davis, and millions who care about justice should have an opportunity to have the new evidence in this case heard. I pray the United States District Court agrees that nothing less than absolute guilt should be proved before executing anyone. As it stands, there is reasonable doubt of Troy's guilt even without a new trial. Troy Davis is under a gag order and cannot share any information with the public about his case, including new evidence that he feels should clear his name. He has been denied a new trial repeatedly for years, which would shed light on all facets of this case. Troy Davis and Officer MacPhail deserve crystal clarity in this matter.

MARCH 2011 UPDATE: In August 2010, Judge William T. Moore, Jr. of United States District Court ruled that Troy Davis failed to prove his innocence in the 1980 slaying of off-duty Savannah police officer Mark Allen MacPhail and will not get a new trial. The court denied Troy Davis' request for a new trial before a jury of his peers. Regarding the hearing before Judge Moore, Wikipedia reports, "Davis did not take the stand in his defense and did not call Sylvester Coles as a witness. He also did not call some of the other witnesses who had given affidavits on his behalf, even though some of them were present in the courthouse." SavannahNow.com reported, "A month later, Davis' appellate team filed a motion seeking to re-open the record because they argued Judge Moore had improperly barred several witnesses. Attorneys with the attorney general’s office opposed the move, arguing Davis’ lawyers made strategic decisions not to call certain witnesses and should not now be allowed to benefit from their choices." On March 28, 2011, the U.S. Supreme Court rejected Troy Davis' final appeal. The only thing stopping Troy Davis' execution now is Georgia's lack of sodium thiopental - an anesthesia that comprises one of the three shots used during lethal injections.
SEPTEMBER 2011 UPDATE: Troy Anthony Davis was killed by lethal injection on September 21, 2011.

Citizens Police Gang Stalking Mary Neal's Family
Seven (7) paragraphs, 11 links -- CHINA IS MOVING AHED OF THE UNITED STATES in protecting citizens' rights. Police in China are being tried for torturing a citizen. My mentally and physically disabled brother was secretly arrested and murdered in Memphis Shelby County Jail and the DOJ is helping to cover up the murder. In fact, the FOIA request we sent to the USDOJ in May of 2009 was answered. The Department of "JUSTICE" REFUSED to respond with records on Larry's murder and the false testimony and records that Memphis Shelby County Jail entered into United States District Court during hearings that were held to determine if the jail was worthy of being released from federal overview for all the other inmates it killed or abused. Since Larry's murder, three more federal lawsuits were filed regarding murder and abuses of mentally ill citizens in Shelby County, but their lawsuit didn't get to trial either. PAY ATTENTION. I may be a bit narcissistic. I thought that the "citizens police" in my area were all assigned to watch our family. I was riding with a neighbor recently who pointed out a house on my street and told me a spy lived there. My friend Lee claimed he observed the resident in that house stealing his garbage and also garbage bags belonging to neighbors on his street during the night. Lee has cameras around his property, so the theft may be on film. Lee told me the next morning he drove by the house where the "trash man" lives and saw his own garbage on the "trash man's" curb for pickup by the county garbage trucks. Lee recognized some of his things protruding from the bag. People can learn volumes about you by digging through your discards. That is what America is becoming. On the other hand, perhaps it has always been this way. When I worked in a law office that helped clients regarding their social security claims, some of the elderly Negro clients complained that their social security checks did not reflect income for all the years they spied on Martin Luther King and others during the civil rights movement. (Dated terminology deliberately used). Perhaps the feds thought those retired "citizens police" would be too embarrassed to admit they had done that work and quietly accept the loss on their retirement income. But "citizens police" types are completely mercenary and nothing embarrasses them.

People who are outspoken about denial of human and civil rights in the U.S. are terrorized and censored because the camps and railroads are not ready yet, so fascism is undercover. Since we stay home all the time, NEW neighbors moved in homes that were previously vacant with no for sale or for rent signs for months. The neighbors across from our home had deliveries the week they came by an 18-wheeler DOT truck. Every time I write something about "citizens police," they delete the post. This is what America has come to - people like me who ask WHAT HAPPENED TO LARRY NEAL? and try to advocate for human rights for prisoners are surrounded by "citizens police" who do gang stalking, put my PC on a network to control my input, and follow me when I leave home. I used to be able to have Net Freedom at the library using their PCs, but I have to log on with a library member number, and the cyberstalkers now attached themselves to that and take over my use of library PCs. The USDOJ ought to just take a lesson from China where police are being prosecuted for torturing a citizen, and stop helping Shelby County Jail, Memphis police, The Johnnie Cochran Firm, and others get away with murder and the cover-up conspiracy that followed.
