NY Claims Right to Kill Black Patients

Please see an excerpt from an Associated Press report below that shows the Government claims a right to torture or kill black people who use government benefits or are prisoners:

ALBANY, N.Y. — A spokeswoman for the New York state institution where a mentally disabled man's death has been ruled a homicide says officials were obligated to bill the man's estate almost $12 million for his care over 10 years or risk losing federal Medicaid funding.

Spokeswoman Jennifer O'Sullivan says the state was following federal Medicaid obligations in seeking reimbursement recently from the estate of Rasheen Rose.The 33-year-old man died two years ago at Fineson Developmental Center in Queens and his sister has filed a lawsuit accusing the staff of killing him. They deny any wrongdoing. (Link to full report is below.)

New York billed Rasheen Rose's family $12m for his mistreatment that culminated in his restraint chair murder. If his sister is awarded $5m for his wrongful death, Rose's estate would still owe the State $7m. The answer might be to raise the amount of the plaintiffs' demand, but some states have caps on the amount of recovery for personal injury damages (follow the AllLaw.com link at the end of this article.) As I reported years ago, families of murdered black mental patients are intended to just thank the murderers, then go home and eat chicken.

The idea behind New York's lawsuit is that the State owns black people who have received government benefits or are prisoners. The State claims the right to torture and murder them without the fear of paying any damages. Under this standard, consider the following:

~ The estates of murdered prisoners' can be charged for the time the prisoners were incarcerated plus court fees and legal fees that brought about the deadly incarcerations.

~ Murdered and abused children who suffer in State custody may be charged for their time in State care plus court fees and legal fees that delivered the children from their parents' custody.

~ Neglected or murdered medical patients treated by State-financed facilities (like the patients killed by hospital staff during Katrina) can be charged for Medicaid payments that were used to pay for their medical care. The same is true of elderly and handicapped people who are abused or murdered in any State-run facility.

~ Black people injured or killed by food poisoning can be sued for the amount of food stamps they received throughout their lives if they sue the State for allowing tainted food into their food supply.

Black people who are deliberately kept impoverished in the United States are still considered chattel. Ownership has shifted from private hands to the Government which sustains them. The State declares in this lawsuit that it has every right to abuse its chattel's human and civil rights. When murders and other crimes against humanity happen, whether intentionally or by criminal negligence, the aim of this lawsuit is to ensure that no money goes to African Americans for losses. Therefore, killing and brutalizing black people in the United States of America becomes the prerogative of their owner, the Government, just as slave owners could brutalize and kill their "property" without fear of lawsuits or criminal charges

Many people do not know that insurance for mental hospitals was not included in the national health plan bill that Congress passed in March 2010. YOUR help is needed to decriminalize mental illness in America. Sick people deserve treatment in hospitals or community care depending on their ability to live outside a controlled environment, not imprisonment. We have another chance! Federal bill H.R.619 was introduced in Congress in January 2009 by Rep. Eddie Johnson (D-TX) to resume Medicaid for psychiatric inpatients. Elimination of Medicaid for mental hospital insurance several decades ago led to today's crisis: 1.25 million mentally ill inmates in America, including 60% of the people enduring solitary confinement torture. Smuggling Human/Civil Rights News in USA

July 2013 update: These are the days. Everything that I have exposed about my persecution and censorship is being validated in news reports throughout the world. It seemed incredible to many people that my mail was being monitored three years ago when I wrote about stalkers who followed me to the post office and interrupted my mail. I had given up trying to use the mail service at my personal mailbox at the street in front of our home and the post office boxes I rented. This week it was revealed that YOUR mail is also being tracked. So far, all that has been revealed to the masses is the huge NSA monitoring program that intrudes on privacy rights of Americans and other countries. Nothing is revealed about the widespread censorship yet. My mail was not only monitored but actually intercepted and prevented from delivery. My email messages (incoming and outgoing) are not just read by agents but also prevented at will or delivered without certain links and sentences that I had written.  The Times can tell you that your mail is monitored. DESPERATION TO CONTROL my communicating with others about civil and human rights violations extends to U.S. Mail. I mailed a CD filled with videos of real-time cyberterror and cybercensorship to various organizations and individuals I have met over the course of my family's justice quest. It took two days for my overnight Express Mail package to reach Rev. Pinkney. It took 10 days for a Florida publisher to receive my mail from Atlanta. The tape on the envelope had been slit, and the CD inside was BROKEN. Another addressee reports that she did not yet receive the mail I sent to her on March 8. Lack of respect for U.S. Mail is not surprising to me. After all, The (Johnnie) Cochran Firm used U.S.P.S. to send my family fake reports of what the firm was doing regarding the secret arrest and WRONGFUL DEATH OF LARRY NEAL while the firm actually did zero (mail fraud). Denial of justice to Larry Neal's family and millions of Americans who are either imprisoned or in danger of future incarcerations due to mental illness clearly indicate that the U.S.A. has moved far from democratic ideals. Discriminating against citizens with a health condition that affects 1 in 5 Americans is evident since psychiatric hospitalization is omitted from H.R. 3200, the proposed national health care plan. The lack of investigation and denial of due process of law regarding Larry Neal's murder under secret arrest in Memphis/Shelby County Jail in 2003 and his family's persecution for asking for records and accountability show the systemic prejudice against citizens with mental dysfunctions that is allowed and perpetuated by their government. The fact that my online communication is interrupted and censored to the point that I have amassed a library of videos such as "Prison Labor Profits" at YouTube showing cybercensorship and cyberterror validate concerns about communism replacing democracy in America. I am apparently denied free use of U.S.P.S. services to mail CDs and documents that evidence discrimination against lifelong mental patient Larry Neal and millions of other Americans.

As director of Assistance to the Incarcerated Mentally Ill ("AIMI"), attacks against my communicating online and through U.S. Mail about mentally ill citizens being denied treatment has put me in the position of people in the French Resistance who smuggled information after the Nazi invasion. Smuggling mail is apparently required to solicit support regarding the civil and human rights violations against my family and discrimination against America's mentally ill middle-class and indigent citizens. My uncle was with the forces that helped to liberate France. Who will free Americans but ourselves? Voice your objections to the communist direction of America. I filed a complaint with the FBI about the cyberstalking and cyberterror that is evidenced on my videos. I was advised months ago that my complaints indicate that I have become a Cointelpro victim. A news report from MSN on March 16 infers that ALL Americans have become Cointelpro victims. The report states that the FBI uses Facebook, Twitter, MySpace, and LinkedIn to become friends with people in network communities to get in their confidence.

I also filed a complaint regarding Attorney General Eric Holder's DOJ withholding investigation regarding Larry's murder. The Bible says "Be long suffering," so my family has waited for over a year for Mr. Holder to get settled in his new position and investigate Larry's secret arrest and murder in Memphis/Shelby County Jail like he investigated Michael Vick's dogs' deaths for the NFL. I share most of my articles with the DOJ via email. All of my email boxes are monitored and controlled. Incoming emails are frequently deleted, and my outgoing emails are prevented, depending on what I write and to whom. Most efforts to email African American groups, Christian organizations, and prisoner activists groups are usually prevented. Our phone at 678.531.0262 was taken over months ago, and previous phone number before that one. We call and receive calls only to and from people that the controllers allow. Other calls are directed to voice mail, and we do not receive the messages.

Despite my email takeover, there is no doubt that the DOJ received the Neals' Freedom of Information Act request regarding Larry, which the Department of “Justice” refused to answer with responsive documents and information about the lifelong mental patient's secret arrest and death. Mail receipts show that many government officials know about and fail to respond appropriately to the injustice.The "Wrongful Death of Larry Neal" and discrimination against millions of mentally ill Americans like him are censored online and in U.S. Mail, which makes smuggling human/civil rights news necessary in the USA. When I send Mr. Holder a CD of the cyberstalking and online censorship, I anticipate the same unsatisfactory response to these crimes as we received regarding Larry's murder, my family's persecution, and ongoing illegal acts against me to prevent advocacy for prisoners' human and civil rights. Nevertheless, I go through this exercise to awaken Americans to encroachments against freedom for us all - when I am allowed online. The people perish for lack of knowledge.

Some people assume racism alone that led to my family being the only 21st century Americans to have a member secretly arrested and returned nearly three weeks later as a naked corpse without explanation and denied an investigation. Racism certainly is part of the problem, but only part. The truth is that discrimination against mentally ill Americans is usual and ordinary, and it extends to all races and ages. In fact, more mentally ill Caucasians are prisoners than other races. Voters should realize there has been an "elite integration" regarding decision makers' mindset about mentally illness and numerous other issues. It is important to judge your political candidates by the content of their character, not by the color of their skin (adaptation of MLK quote). The stigma attached to mental illness is strong enough to exempt millions of Americans from the national health care plan. No provisions were included in H.R. 3200 for mental hospital coverage. The double stigma of being both an African American male and mentally ill exempts Larry's murder from the due process of law that is applied to dog abuse in the USA. But the stigma is not against African Americans only. Consider what happened to Tim Souders, a young mentally ill Caucasian man who died a slow death over days (torture) on a restraint table in a Michigan prison. Perhaps because Tim was white, his wrongful death was not covered up by authorities and censored by the media like Larry's murder is, and Michigan settled with his mother after she filed a civil suit. But Tim is still just as dead as Larry, despite the fact that his mom is not a victim of justice denied like Larry's mother is and despite Tim Souders' 60-Minutes TV special at the following link. http://www.cbsnews.com/stories/2007/02/08/60minutes/main2448074.shtml

The relevant fact is that Caucasian Tim Souders was arrested and exterminated because he was mentally ill just like Larry Neal was and numerous others. Discrimination against people with mental illness is just as aggrevious to sick citizens and their families as any other systemic discrimination, especially when it results in deaths. Families of mentally ill people do not thank authorities for relieving us of our "problem." Theresa Vaughn would rather have her son Tim alive regardless of his mental health, and Michigan could have used her $3.5 million settlement for Tim's treatment and many other purposes if only his common health condition had been treated, not criminalized. Police officers and prison guards should not be in the position of psychiatric caretakers. It is cruel and expensive. One hundred percent of police officers I polled agreed that acute mental patients do not belong behind bars, but in the absence of mental hospitals, they have no choice but to place crisis patients under arrest. In fact, police have frequently made "mercy arrests" to save neglected mental patients from freezing to death on America's streets.

He was secretly arrested by Memphis police who denied having him under incarceration until he died 18 days later on August 1, 2003, under YET UNDISCLOSED CIRCUMSTANCES. Police were annoyed by the harmless schizophrenic singing loud outdoors and occasionally panhandling.
