Avoiding Teacher's Sexual Overtures Leads to Wrongful Conviction for Matthew Moore, a Louisiana Teen

October 5, 2013 UPDATE: MATTHEW MOORE did his time for a crime he never committed and returned to his job, which he promptly lost. His mother, Katherine Conner, was able to borrow the money that was overdue on her probation and restitution for the "crime" of cancelling a check that was written for $3,500 more than the original contract. Matthew's and Katherine's prosecutor continues his vendetta against black people in Louisiana, including Herman Wallace, deceased.

District Attorney Sam D’Aquilla had Herman Wallace re-indicted for murder a few days after the dying man was released from 41 years of solitary confinement in Angola Prison. Wallace, one of the Angola 3, probably died immediately upon hearing the news in hospice care that he was due in court in December 2013.



“I say he is a murderer, and he is not innocent,” District Attorney Sam D’Aquilla said. “The conviction was overturned because the federal judge perceived a flaw in the indictment — not his murder conviction.”

D’Aquilla said Wallace's attorney Nicholas J. Trenticosta, of New Orleans, was wrong when he said Tuesday that Wallace is “a free man, and he’s innocent.”


October 2012 Update: MATTHEW MOORE was sentenced to jail on October 23, 2012. His words before being taken into custody were, "Don't cry, Mama. I'll be alright. Tell everyone who supported me that I thank them. Ask them to keep praying for me. Call my supervisor and ask him to please try to keep my job open for me. Mama, please don't cry." He served a 120-day sentence and was released in February. Matthew and his family appreciate the support they received during his ordeal.

ORIGINAL ARTICLE:  Matthew Moore speaks on video about his wrongful conviction in Louisiana. Matthew rejected a teacher's sexual overtures when he was 17, and Deborah Anderson retaliated by falsely accusing the teen of revealing his penis to her in a school hall where Matthew worked a summer job. It was Matthew's word against the teacher's, because authorities refused to release videos from the school's surveillance camera to exonerate Matthew. Sentencing was rescheduled to September 11. [Update: On September 11, Matthew Moore's attorney filed a motion for a new trial. Matthew must return to court on October 9, 2012. Please continue to pray for and support this young man who works hard and plans to return to community college once he is relieved of the burden of being wrongfully accused and convicted of a crime that never happened outside of a pedophile's wet dreams.]  Thanks to the Internet, falsely accused people like Matthew Moore have an avenue to share information about their cases and seek help. Paragraph 2 --- MATTHEW MOORE AND HIS FAMILY COULD NOT AFFORD AN ATTORNEY TO APPEAL HIS WRONGFUL CONVICTION. Weeks after Matthew was falsely accused by Deborah Anderson of revealing his penis to the almost 60-year-old woman, a bipolar volunteer teacher made the same accusation against Matthew. The woman had previously been forced to undergo psychological counseling by the school's administration because of her compulsive lying. When Paige Fleming Guillory heard about Matthew's accusation in the school grapevine, the mentally challenged teacher told her own tale of having seen Matthew's penis two months prior. Guillory said she saw it one day when she was going downstairs and passed by Matthew who was taking large boxes upstairs. How a youth walking upstairs carrying large boxes could expose his penis is a feat that was not explained. It would have to be at least three or four feet long to show over the top of boxes! During the trial, the bipolar witness's testimony was not challenged. Neither did Matthew Moore's attorney object to the mentally challenged witness sitting through Anderson's testimony on the stand and writing notes in order to mimic the teacher's testimony. Nothing was presented to create reasonable doubt about either witness. Moore's attorney did not reveal Guillory's mental dysfunction to the jury, and he did not he tell the jury about Anderson's history, which indicates that she is possibly a pedeophile. A male high school student and his mother had lodged a complaint with the Board of Education against Anderson the prior year, alleging that Anderson sexually molested the student.

Paragraph 3 ---  MATTHEW'S MOTHER SOUGHT HELP WAS WAS DENIED ASSISTANCE BY THE SOUTHERN POVERTY LAW CENTER, THE NAACP, AND OTHER CIVIL/HUMAN RIGHTS ORGANIZATIONS, CHURCHES, AND THE NATIONAL EDUCATION ASSOCIATION. Matthew missed classes because he suffered an embarrassing arrest at his school after a judge had told him he could return to school. The system is broken, and impoverished Americans have almost no place to turn for legal healp when treated unjustly. Blacks, Latinos, and whites who lack wealth are often incarcerated  whether or not they are guilty (2.3 million people and counting). Many falsely accused Americans agree to lie on themselves; they plead guilty and accept probation or lesser sentences for crimes they did not do because they lack the money for effective legal counsel. Matthew's jury was not informed about the system's refusal to release videos from the school cameras that should have captured Matthew in the school hall being confronted by Anderson, who admits asking Matthew "Are you modeling for me?" When he answered, "No m'am," and went outside to wait for his mother, the camera would have showed what the police report admits: Anderson followed the boy outside and continued her banter. Few or no women would follow a pervert who had just exposed his penis. Probably enjoying the boy's discomfort, Anderson continued to discuss Matthew's penis while he waited for his mother to pick him up from work. Anderson filed a false report against Matthew only after Katherine Conner, Matthew's mother, demanded to see the school's surveillance videos.

Paragraph 4 --- The jury was not informed that the district attorney, who was also of counsel for the school board and had a vested interest in protecting the school from more student complaints about Anderson's pedophile tendencies. Would any system allow a child's harm in order to protect pedophiles? We should remember that Catholic priests were protected by the Church when children in their care were assaulted. Saving pedophiles from prosecution and the Church from embarrassment and lawsuits were strong motivators. Matthew Moore's jury was also not informed that Matthew's mother had filed a complaint against the district attorney in a separate matter prior to his bringing charges against Matthew, and the district attorney had vowed to arrest her son. Conner feels that Matthew's wrongful conviction was probably retaliation for the complaint she filed against the district attorney and a parish judge. The district attorney told Conner, in front of witnesses, that he would arrest her son because he did not like her "attitude." The prosecutor refused to recuse himself from Matthew Moore's case despite his conflicts of interest, and neither would the judge recuse him. Would learning about these facts have made a difference to the jury? Many juries have said after convicting innocent people that they would have decided differently if they had been given all the facts.

Paragraph 5 --- The jury convicted Matthew Moore based on the witness statements by two educators who were middle aged women with respectable positions. They heard no evidence during the trial to doubt the witnesses' testimony, such as: (a) Anderson's pedophile conduct that was alleged by another student a year prior to the time when Matthew Moore rejected her attempts at sexual banter with him; (b) the second witness's mental instability and documented history of being a compulsive liar; (c) the district attorney's second job protecting the school board as its legal counsel; (d) the district attorney's rage at Katherine Conner for filing a complaint against him and a parish judge in a separate matter that did not involve Matthew, and (e) the district attorney's promise to arrest Conner's son because of her "attitude." Juries can only decide cases based on the evidence they hear in court. Defense attorneys should ensure that juries have all the evidence that would lead to just decisions, but they often do not do that. In fact, some defense attorneys, district attorneys, and even judges are private prison stockholders. Racism and high rates of incarceration are major problems in Louisiana and throughout America. In fact, Louisiana has the world's highest incarceration rate. A New York Times report entitled "Plantations, Prisons and Profits" gives the following data:

• One in 86 Louisiana adults is in the prison system, which is nearly double the national average.

• More than 50 percent of Louisiana’s inmates are in local prisons, which is more than any other state. The next highest state is Kentucky at 33 percent. The national average is 5 percent.

• Louisiana leads the nation in the percentage of its prisoners serving life without parole.

• Louisiana spends less on local inmates than any other state.

• Nearly two-thirds of Louisiana’s prisoners are nonviolent offenders. The national average is less than half.

Paragraph 6 --- In the early 1990s, the state was under a federal court order to reduce overcrowding, but instead of releasing prisoners or loosening sentencing guidelines, the state incentivized the building of private prisons. But, in what the newspaper called “a uniquely Louisiana twist,” most of the prison entrepreneurs were actually rural sheriffs. They saw a way to make a profit and did. Paragraph 7 --- More about the case of Louisiana v. Matthew Moore is at the links below.  Katherine Conner, Matthew's mother, suffered a wrongful conviction stemming from a dispute with a contractor for house repairs after Katrina damaged her home. She overpaid the contractor by approximately $3,500. When the contractor refused to return her check and accept one in the correct amount, Katherine canceled it like anyone would. The contractor then falsely accused Conner of theft of services. That began the ordeal for Katherine Conner and her son, neither of whom had any priors. After her complaint, Matthew was falsely accused and convicted. Retaliatory arrests remind one of famous man from Morgan City, Louisiana, Geronimo ji Jaga Pratt, who was set up on false charges in the FBI CoIntelPro program after he began advocating for civil rights for African Americans. Geronimo endured 27 years of incarceration, eight of them in solitary confinement, until he was finally exonerated by a legal team that included Johnnie Cochran in 1995. After his exoneration and successful lawsuit regarding the injustice, ji Jaga's godson Tupac was murdered, and Johnnie Cochran's 16-year-old nephew was murdered as he rode his bike with a friend. Cochran's brother was also assassinated. None of the cases were resolved. Matthew's case also reminds one of Private Manning, a young man who is presently incarcerated after exposing to Wikileaks certain military behavior in Iraq that he found objectionable. Therefore, the legal system sometimes persecutes whistleblowers like Katherine Conner. She filed complaints against a judge and prosecutor who took a case to criminal court that she felt should have been handled as a civil action rather than as a criminal matter that put felonies on her record. The felony convictions prevent employment in a tight job market. Katherine also believes that the court should have reduced the amount of her probation when a higher court so ordered. She now pays the probation office more than of half her income, and her savings were used for defense attorneys for herself and her son in the criminal matters before you.

Paragraph 8 --- Judges and prosecutors have large caseloads. If the prosecutor and judge did not hear or fully understand Matthew's account of what really happened, we hope the court will carefully consider Matthew's side of the events before sentencing. It should not take much effort to investigate prior allegations against Deborah Anderson by a mother and son who complained to the school superintendent about Anderson's inappropriate sexual advances on the student. They asserted that Anderson actually fondled the teen. That was information that Katherine and Matthew did not know when Anderson made advances toward Matthew and falsely accused him when he rejected her like another student did a year before. Paige Fleming Guillory's documented history of compulsive lying and mandated psychiatric counseling would also be easy to verify. Guillory's testimony might have been less convincing to the jury if she had not remained in the courtroom taking notes through Anderson's time on the witness stand, but Matthew's attorney raised no objection to that. Paragraph 9 --- Grassroots organizations and activists have helped Katherine and Matthew to communicate their trouble. The family is thankful to everyone who supports them through the stressful ordeal. Roughly 1,400 people joined the "Save Matthew Moore" Facebook group the first weekend Katherine Conner shared her family's predicament on a radio show. People are aware of statistics showing that America has between 5,000 and 10,000 wrongful convictions annually. I once lived next door to a retired police detective who said his greatest concern during his years on the force was that he might help convict an innocent person. The risk of wrongful convictions is higher among minors and mentally challenged people. The main causes for wrongful convictions were identified by Ronald Fraser, Ph.D and published in a Buffalo News article in September 2009. Dr. Fraser gave the percentage of effect for each factor that contributes to wrongful convictions: (a) misidentification [and false testimony] by eyewitnesses (75%), (b) unvalidated forensic evidence (50%), (c) lying government snitches (16%), and (d) false confessions by juveniles and mentally challenged suspects (25%).

Paragraph 10 --- See and excerpt from a report in "Criminal Justice Bulletin, Qualitatively Estimating the Incidence of Wrongful Convictions (Volume 48, Number 2)" by Marvin Zalman, which is called  "Setting the Stage: How Many Wrongly Convicted?" - Within the past decade, innocence consciousness (the sense that wrongful convictions regularly occur, that they result from structural errors in the criminal justice system, and that as a result, improvements need to be undertaken) has gained a foothold in the legal and criminal justice communities. Under the innocence banner, a host of reforms have begun to move the adversary and criminal justice systems toward positive changes in police interrogation, forensic science, and many other areas. It is good news that positive change is expected in the future to stop so many wrongful convictions from happening, but will that matter in Matthew's case?

Paragraph 11 --- Matthew, who was always a slim person, lost roughly 30 pounds since he was falsely accused at age 17 of exposing himself to a teacher who is old enough to be his grandmother while working his third year on a summer job that meant a great deal to him. Especially with his mother not working, Matthew counted on his summer job to purchase school clothes and supplies and pay for graduation and prom costs. He would certainly not have risked his job even if he suddenly found himself attracted to a woman old enough to be his grandmother - a very far fetched idea. Matthew finished high school and enrolled in community college despite his stress. Matthew had to leave the college because it was hard to concentrate on classwork with all that was happening, but he found a job this summer. Working helps Matthew cope with the uncertainty of his immediate future. Paragraph 12 --- Wrongful convictions separate families, irreparably harm the lives of innocent people, negatively impact communities, plus cost taxpayers unnecessary money to punish or supervise people who have done nothing wrong. America is not as careful as needed to protect citizens' right to life, liberty, and the pursuit of happiness. People who do not have the revenue to fight wrongful convictions in court suffer. Unfortunately, some wrongfully convicted people have been executed. More innocent inmates could be killed or spend years behind bars because they are denied DNA tests and because courts have no obligation to consider an inmate's post-conviction evidence, even if that evidence definitely exonerates him. Freedom for Egypt, Iran, and Mary Neal!

The photograph shows one of the protests that ousted Egypt's oppressive dictator on February 11.  American leaders warned Iran to take note.  "I SAY TO OUR IRANIAN FRIENDS:  Let your people march, let your people speak, release your people from jail, let them have a voice!" Biden said, and received loud applause at the University of Kentucky.

I saw Vice President Biden make that statement this morning.  I woke up early to check for Black History Month programs in the Atlanta area.  The cyber censorship team promptly shut down my Internet access in fear that I might attend some of the activities, so I watched a little of the morning news.  Then the same concern prompted them to turn my Internet back on so I won't leave home to use a computer that is not as much in their control.  Here is my prevented tweet for this a.m.:

Iran may have good reasons for not allowing freedom of expression.  If the people of Iran are allowed to speak, they may ask about:

DEAD CITIZENS, like my brother, Larry Neal.  He was a mentally and physically disabled man who was secretly arrested for nearly three weeks in Memphis Shelby County Jail and murdered on August 1, 2003 - http://wrongfuldeathoflarryneal.com/ - News of his death and subsequent cover-up is censored in U.S.A. media, and I am censored online to prevent widespread accounts about his murder and about victimization of other mentally dysfunctional Americans.

Iran may not want to discuss arrests.  Maybe prisoners are money-making commodities over there, too.  Iran may not want its citizens to march.  My cyber censorship team agrees. My Human Rights for Prisoners March across the Internet is censored.  The team deleted 11,000 of my Twitter tweets on December 6, 2010 - http://twitter.com/koffietime - and continually interferes with my  Internet access when I write about:

a.  Mental illness being criminalized and America's 1.25 million mentally ill inmates;
b.  Post-conviction DNA testing rights to release innocent Americans;
c.  Opposition to capital punishment;
d.  America's high incarceration rate - the highest of any nation in world history;
e.  Racism in the justice system and the disproportionate incarceration rate for blacks:  1 in 9 among young men under age 34;
f.  Classism in the justice system, with prosecution largely restricted to "slave class" citizens (minorities and poor whites);
g.  Political prisoners - human/civil rights activists incarcerated on questionable charges, such as Geronimo Pratt was for 27 years;
h.  Human rights for prisoners, i.e., slavery (enforced work programs); poor health care, such as tooth decay releasing infections into inmates' bloodstreams resulting in deaths; inadequate meals (Georgia inmates cited malnutrition during their labor strike in December 2010); brutality and murders, which the United States Department of Justice helps to cover up rather than investigate and prosecute, like my disabled brother's.

If Iranians had free speech, they might complain about abuses of power, such as:

a.  my censorship, in person and online stalking, and threats of arrest by Atlanta Police for telling people about the secret arrest and murder of Larry Neal and asking for fairness in the Kathryn Johnston civil action;
b.  COINTELPRO-type programs like the one presently using The (Johnnie) Cochran Firm to (i) gain confidential information on/from minorities by misusing attorney/client privilege; (ii) pervert justice by limiting or eliminating payouts to the firm's clients after police brutality or victimization by certain corporations; and (iii) withhold adequate representation for certain clients facing criminal prosecution.  This started following Cochran's death, which occurred shortly after he became "partners" with people he should have investigated better, especially since he was on the Geronimo Pratt  defense team, which subpoenaed federal records and exposed COINTELPRO's agenda against civil rights, and Cochran announced plans to establish a Reparations Dream Team to recover damages for African Americans. Those events undoubtedly made Cochran fit the FBI's enemy profile of "Black Messiah" like Dr. King did. 

While researching COINTELPRO, I was not surprised to run across a photo of famous civil rights photojournalist and FBI informant Ernest C. Withers being chummy with Johnnie Cochran. Withers ingratiated himself to Dr. King, also, and was still on the job 40 years later, apparently. The photo was probably taken while Cochran was opening the firm's Memphis office (which the treacherous law firm denied exists when my mother and I sued The Cochran Firm for working behind our backs with Shelby County Jail to prevent justice regarding Larry's murder, just like the firm also denied having any law office in Georgia). Many prominent black people are COINTELPRO like Withers was.  It is practical from the government's standpoint to use insiders to derail black people's justice quests, such as attorneys.  The job probably pays sellouts well and helps with advancement, especially for minority business owners like media companies, so-called public servants and even some civil rights activists. Ernest Withers, pictured above in his Afrocentric hat, was about as "inside" as one can get.  His photography chronicles the segregated South and many memorable civil rights events, such as King's marches, then his blood on the Lorraine Hotel balcony.  Most of my stalkers are black, also, and it is likely those ordering my persecution for asking WHAT HAPPENED TO LARRY NEAL include blacks.  So is Julian Bolton, Esq., a former Cochran Firm managing partner in the firm's now-you-see-it-now-you-don't Memphis office and a former Shelby County Commissioner.  Bolton held both positions when I took my elderly mother to contract with The Cochran Firm, but he hid his conflict of interest in order that my family would hire The Cochran Firm as Larry's wrongful death attorneys in 2003.

Bolton ran for U.S. Congress in 2006 and lost, which is a shame.  He might have been right at home in Washington with Rep. Alcee Hastings (D-FL), who introduced H.R.645 in 2009 (the concentration camp bill).  Maybe they'll have Hezekiah Sistrunk, Esq., managing partner of The Cochran Firm's peek-a-boo Atlanta office, run for office some day.  Many voters do not look beyond race and party lines, and that is useful for certain purposes.

Oops - the cyber censorship team just switched my Internet connection!  I'll attempt to finish this post using theirs.  It is too cold right now to catch the bus to find a computer and review today's Black History Month activities in Atlanta, and I no longer have a car.  It was repossessed a couple of years ago when I declined my employer's kind invitation to move to a position that would be safe from layoff during restructuring at the law firm where I was a legal assistant.  Although my faith in God is strong, it was unnerving being followed home from work every night.

I did not know when I was laid off, of course, that advertising income from my online articles would be prevented, communication with potential employers in the future would be hampered by a phone tap and email monitoring, or that The Cochran Firm is protected by U.S. courts from defrauded clients' lawsuits (the firm is allowed to plead "not guilty by reason of nonexistence").  I noticed long ago that there is no assurance that using another computer will make an appreciable difference in my freedom of expression online.  Most of America's justice problems revolve around prison profits, and according to Dr. Boyce Watkins, Microsoft itself uses inmate laborers.  See a link to Dr. Watkin's informative article in my next blog:  Human Rights for Prisoners Boycott 3/9/11: http://freespeakblog.blogspot.com/2011/01/human-rights-for-prisoners-boycott.html

Cyber censorship team, please don't shut my PC down.  I was just about to point out that although many Americans publish news and viewpoints that are adversarial to the status quo, violent retaliation is rare.  Despite problems, I could not have this blog in any openly totalitarian country.  Egypt's crisis proves that democratic elections and open discourse between people and government comprise the preferable way to avoid and resolve issues.  That happens in America to an equal or greater degree than other countries.  Some rulers probably look at FreeSpeakBlog and other Internet submissions by Americans and mistakenly see it as a weakness on the part of Western officials to allow free speech.  They do not understand that bearing criticism and considering citizens' concerns show strength in our leaders, attesting to the fact that this country's Constitution honors the principles of freedom - not commanding blind obedience but engendering respect by the people governed.  Even God Almighty invites, "Come, let us reason together" (Isaiah 1:18). Mutual respect between citizenry and leadership is imperative to a lasting peace.

I want to thank Google Images, where I found the picture above of the skinny, half-naked boy standing against the powerful Egyptian police and military like a tiny Moses. (I cannot read what is written on the photo, so please disregard it if it is profane or threatens violence.) I felt an immediate kinship with the child who has more audacity than seems healthy.  Sometimes, I scare myself, then I remember that my Lord said, "Do not be afraid, but speak, and do not keep silent. For I am with you and no one will attack you to hurt you; for I have many people in this city." (Acts 18:9-10).  With 1 in 30 Americans either in prison or on standby as parolees and probationers (1 in 13 in Georgia), millions of Americans have a vested interest in human rights for prisoners, which is what God chose me to request on behalf of the incarcerated mentally ill and others without regard to socio-economic distinctions, race, creed, color, or national origin.

The entire world is God's and all the fullness thereof - including everything and everyone.  We should praise Him for being no respecter of persons. He sees value in each human being, even sick people, the impoverished, and those who come short of His glory through sin, as we all have.  God bless America for being a country where I can publish concerns (although it is a battle to do so) and exalt Jesus Christ in a world with many Samaritans who consider how they might profit by the situation upon meeting fellow travelers fallen by the side of life's road.  See my latest battle at Twitter below.

I later started publishing my censorship in a blog called "Justice Gagged," but I still used tweets in 2011; i.e., see below:

March 4, 2011March 4, 2011 - My censorship using Twitter continues.  I tried to add these tweets to my article "FREEDOM FOR EGYPT, IRAN, AND MARY NEAL" at this link - http://freespeakblog.blogspot.com/2011/02/freedom-for-egypt-iran-and-mary-neal.html -   U.S. Warships are on the way to Libya to help people who want to live in a democratic society.  I am much closer than Libya, being censored and stalked online and in person in Georgia USA.  The first 17 tweets below suddenly disappeared from my Twitter profile page after I tweeted the CBS link carrying news about the individual Internet I.D. number that each American may soon be assigned by the government. 

I hate to see everyone in the country have their Internet usage controlled and electronic communication subject to interruption like mine.  The 40 tweets below the first 17 did seem to remain on my profile page at Twitter.  They may or may not have actually posted to my followers' pages.  I am so censored that the best way to follow me at Twitter is to view my profile page http://twitter.com/koffietime .  My tweets sometimes do not get posted, and some are coded to appear among tweets that posted hours before to minimize exposure to my subject matter and links I share.

I put a video at YouTube showing that censorship in real time on channel jkempp703.  On December 6, I had 11,000 human/civil rights tweets suddenly disappear.  Thankfully, Twitter was able to reinstate them (on my view, anyway) after I complained for two months.  I do not really know what is online and what isn't. The cyber censorship staff can send computer-specific views.  Read more about that in my article:  "INTERNET CENSORSHIP AMERICAN STYLE BY MARY NEAL."  What is my censored subject matter?  I make a simple request to our decision makers: "Do unto others as you would have others do unto you."

The tweets above disappeared from my profile page effective five minutes ago  (I corrected my spelling in the above re-published tweets - Libya, where U.S. war ships are headed to liberate people while my family is surrounded by "citizens police" (Google that) and I have to wrestle with the cyber censorship team to post anything online).  That happened after I shared the CBS link regarding the Individual Internet I.D. that each American may receive in a few months,  I doubt if it actually posted, although it shows as having been posted on my home page.  Once you get your Internet I.D. number from Big Brother, you can easily be censored like I am. You will be required to input your personal Internet I.D. number to go online, which will identify you as the user.  If you are a "targeted person," your net freedom will end, if you actually have it now.

Under the PLAN, you will no longer have passwords for your emails or online groups.  But don't worry.  Only you and Big Brother will know every word you type or receive.  My Twitter icon is a coffee cup to remind everyone to please wake up - It's KoffieTime!  The censorship force does not usually let it appear, so I posted the picture at the bottom.  Sometimes we fight for an hour over a single picture I want to post online.
