Jerome Murdough's Family Jipped in Wrongful Death Settlement

SETTLEMENT REACHED regarding homeless vet baked to death in Rikers Island solitary jail cell - $2.25m. I told you The Cochran Firm frauds would never take the wrongful death of Jerome Murdough case before a jury. Lawyers demanded $25m but settled for less than 10 percent of the demand - then the family's attorney congratulated the defendants for being "willing" to pay that much.

Attorney Derek Sells, who represented the family, said the agreement was “a sign that the administration is willing to work with people mistreated by city agencies and officials.”

Murdough's family members were not told the veteran was dead by any jail or city officials - they found out from an AP reporter who called them for a statement WEEKS LATER. Murdough's death would probably have been covered-up like Larry Neal's is had it not been revealed by AP. This was likely to avoid a wrongful death lawsuit. Luckily for defendants, Murdough's family contracted The Cochran Firm frauds as their wrongful death attorneys. Happy Veterans Day.

A white man who was traumatized by solitary confinement (not baked to death) was awarded a $15.5 million settlement. During the time Stephen Slevin, 58, spent in solitary confinement at Doña Ana County Detention Center, his mental and physical health deteriorated so severely that he spent hours on end rocking back and forth beneath a blanket, his attorney told the Los Angeles Times. "Slevin even wiggled a tooth loose so he could yank it out," Matt Coyte said. Compare Slevin's settlement to Murdough's.

Next, we wait to see what settlement, if any, is reached for the wrongful deaths of Chavis Carter and Walmart shopper, John Crawford. Their black families also contracted with The Cochran Firm, because they did not know any better.

Stand Down, Ferguson: Camps Ahead

What happened during the Rodney King riots was a desperate attempt by a people who had long been deprived of due process in courts of law. For a period of time, African Americans were hopeful that police violence would be dealt with fairly in criminal and civil courts. That has not been the case. Therefore, the possibility of riots might indeed exist if Wilson is acquitted, but only because the justice system has failed to deliver on its promise of equal justice. In the event that the grand jury fails to indict, I certainly hope that there is no property damage and that no more people are hurt or killed in Missouri or elsewhere. I believe the best course of action if Wilson is acquitted is to press the U.S. Justice Dept. to levy federal charges, as was done in Rodney King's case, and that further demonstrations while tempers are high would be counterproductive.

Whereas Zimmerman was not a government employee, and the police had reportedly told him to stand down, that is not the case with Wilson. Federal prosecution should be the response to an acquittal by the Ferguson grand jury, should the acquittal occurs.

There is a time for all things. Ferguson is going to the United Nations, and the Justice Department has a job it should do to protect the right to life in the USA. Meanwhile, I caution protesters to be cognizant that in December 2011, the president signed the NDAA law, which permits the USA to detain citizens indefinitely without trial or any opportunity for defense. Many of us fought this law from coming to be, and we still oppose it. I perceive this law as a threat to the very idea of liberty and justice for every American, but particularly for the group that has the highest rate of incarceration presently, often without fair trials: African Americans.

Michael Brown was young and inexperienced, and so he died. I am convinced if he had known Officer Wilson would kill him, Brown would have obeyed Wilson immediately without words. The Ferguson protesters are not ignorant like Brown was about the viciousness of militarized police. At least two more young black men were killed in that area since Brown was, and a black woman is hospitalized with a gunshot wound to her head reportedly delivered by Ferguson police. Therefore, I implore Ferguson protesters to "go nowhere with an angry man," as the bible instructs. We have other options, the most important of which is to let tempers cool before embarking on any course of action should Officer Wilson be acquitted. History should teach us that any excuse would do to disregard the human and civil rights of African Americans, and there is a law that says "anything goes." Be angry, but exercise patience.

We have been concerned for some time about Martial Law and people being interned in the concentration camps that are waiting in America and foreign countries. It appears that the powers that should not be do not attempt to justly remedy wrongful deaths such as Brown's and my brother's and many other blacks endured in hopes that African Americans will give an excuse to institute Martial Law and use the concentration camps that are reportedly prepared, staffed, and stocked with supplies. How we respond to Ferguson if Wilson is acquitted could have eternal ramifications for all of us - meaning everyone in America. We have the ability to chose peace, which is really the only reasonable choice when opposed by such a formidable foe as this country can be if a people threatens its security.

Unless you want to be a suicide warrior and completely destroy this troubled peace we have had in this country since slavery officially ended, I advise everyone to STAND DOWN. There is a smarter way: Boycott 4 Justice.

Treatment vs. Homelessness, Torture and Death

Enforced psychiatric treatment and subsistence assistance under assisted outpatient treatment programs (AOT) are preferable to imprisonment for mentally challenged people. My brother and many other sick people were and are tortured and murdered every year in jails and prisons throughout the country -- if sick people live through their lunacy arrests by paranoid, untrained cops.

Enforced treatment is not needed for people who are able to manage their psychiatric conditions and stay out of jails and hospitals. However, statistics proved that AOT programs would reduce recidivism for the nation's 1.25 million mentally ill inmates, save lives, reduce homelessness, and restore many people to wholesome living.

AOT programs cost significantly less than incarceration. Consider that each inmate in New York costs taxpayers $168,000 per year to warehouse. Private prisons began AFTER budgets for America's most vulnerable people -- the mentally ill -- were cut, and they became inmates rather than inpatients and outpatients. Families throughout the country of all races are greatly traumatized when the injustice system captures and imprisons their sick relatives for behavior they could not control and breaking laws they did not understand. Only prison investors are happy about jails and prisons having become America's new mental hospitals. Mandatory AOT programs would shift most of the $80 billion+ annually that is presently going to the prison system back to psychiatric treatment and subsistence assistance.

Whereas sudden cessation of heart drugs can cause death, sudden cessation of psychiatric drugs can cause psychotic episodes that threaten not only mentally ill people but also their families and communities. I believe that most mentally ill inmates are on psychotropic drugs. To release them without a mandate for continuing their treatment under the care of a qualified mental health facility is dangerous for them and for society. To release mentally challenged inmates without provisions for their nutrition and housing is unethical and immoral - a setup for their return to prison or worse.

People who are beyond making rational decisions are disabled and deserve food and housing as well as appropriate medical and psychiatric treatment whether or not they agree. What are your thoughts on mandatory AOT programs for all mentally ill people upon prison and jail release?

The October 22 Coalition to Stop Police Brutality, Repression and the Criminalization of a Generation has been mobilizing every year since 1996 for a National Day of Protest on October 22, bringing together those under the gun and those not under the gun as a powerful voice to expose the epidemic of police brutality.

The Coalition also works on the Stolen Lives Project, which documents cases of killings by law enforcement nationwide. As the director of Assistance to the Incarcerated Mentally Ill, I certainly looked forward to the October 22 Coalition protest in Atlanta today. Unfortunately, my elderly mother is unwell and I may not be able to attend. Therefore, I ask that organizers please be mindful that over 50 percent of police violence victims are people with a history of mental illness. They are attacked and often killed by police in their homes, on our streets, and behind bars. The mentally ill also comprise over half of America's prisoners: 1.25 million sick people are wrongly incarcerated rather than treated in their communities or mental hospitals. Budgets for mental health care were cut in order to arrest sick people and start America's private jail and prison system. In Atlanta, homeless shelters are being closed so that more of these people will be arrested than before. Two homeless shelters already closed, and the Atlanta Task Force, which houses some 900 people, is fighting in court to survive. Mercenary people want the prime Midtown Atlanta property where the Task Force sits, and prison investors want the homeless jailed.

In 2014, we were made aware of numerous murders against people with mental illness, including Jerome Murdough, who was baked to death in Rikers Island, Darren Rainey, who was boiled to death in Dade County Correctional Facility, and too many more to name. Recently, Milwaukee's police chief fired an officer who picked a fight with a mentally ill teenager in the park then shot him 14 TIMES. Police aggression is directed mostly at black people and the mentally ill of any race. We need to talk about this and make sure everyone is aware of the numerous assaults on society's most vulnerable members. As usual, the victims are mostly people who are black, brown, or poor.

I would be grateful if you mention the fact that most victims of police violence and brutality behind bars are also mentally ill people. There are approximately 80,000 inmates in cruel solitary confinement today, and over 60 percent of them are mentally ill. Approximately 80 percent of inmates in SHU are black. There seems to be no attempt on the government's part to end torture of American prisoners. In fact, Solitary Watch revealed that in the U.S. report to the United Nations that will be filed in November denies that solitary confinement is systemically used against juveniles and the mentally ill in America.

These are a few of the concerns that I wanted to address today at the October 22 Coalition protest in Atlanta, but I must ask that you do this instead. Please don't let oppression of our people who experience mental disabilities go without mention. AIMI plans an International Court action for 2015, when we will take such murders as my own disabled brother suffered before the United Nations and the world. I am very grateful to the sponsors and organizers of the October 22 Day of Remembrance and protest against police violence. It means a great deal to me as the sister of a man who was secretly arrested for 18 days and murdered in jail, especially since Larry Neal's murder was covered-up. Cover-ups of jailhouse murders are possible to a greater degree than murders that happen in public where people film police violence. I am thankful that due to many news reports, especially by the Miami Herald, many jailhouse murders of mentally ill people and others are being revealed to a greater extent than before despite cover-ups.

U.S. to U.N.: What Prisoner Torture?

Families of mentally ill American inmates were astounded to read the headline below in Solitary Watch.com: U.S. Government Tells UN Committee on Torture: “There Is No Systematic Use of Solitary Confinement in the United States” 

I published the following comment at the article: 
With so many super max prisons and solitary jail/prison cells in the USA, it is surprising that the USA would deny its systemic use of solitary confinement. It is estimated that roughly 80,000 inmates are in solitary confinement, some for decades. Over 60 percent of the isolated inmates are mentally ill people who should be treated as psychiatric inpatients or outpatients, not punished for offenses that arose from their health disabilities. Assistance to the Incarcerated Mentally Ill (AIMI) plans to file an action in International Court against the USA for long-term homelessness, brutality and wrongful deaths of mentally ill Americans, especially mentally ill inmates who were denied timely psychiatric treatment to prevent offenses that led to harsh punishment. According to Solitary Watch, the USA plans to deny systemic use of solitary confinement in its report to the United Nations and claim that American citizens are protected by the U.S. Constitution from such cruel and unusual punishment. The report says in part:

The United Nations Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT) forbids “any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person” for the purposes of intimidation, coercion, forced confession, or punishment, “when such pain or suffering is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity.” The United States asserts that it is in all cases in alignment with CAT. See the "protections" that Americans allegedly have:

The U.S. Constitution, along with federal and state laws, establishes standards of care to which all inmates are entitled…U.S. courts have interpreted the Eighth and Fourteenth Amendments of the U.S. Constitution as prohibiting the use of solitary confinement under certain circumstances, especially with regard to inmates with serious mental illness or for juvenile detainees. (Specifically, under the Eighth Amendment’s prohibition against “cruel and unusual punishments,” correctional facility administrators may not subject inmates to solitary confinement with deliberate indifference to the resulting serious harms, including suicides, suicide attempts, and serious self-injury. See Farmer v. Brennan, 511 U.S. 825, 843 (1970); see also, e.g., Madrid v. Gomez, 889 F. Supp. 1146, 1265 (N.D. Cal. 1995) (using prolonged solitary confinement on prisoners with serious mental illness can be “the mental equivalent of putting an asthmatic in a place with little air to breathe”) …

People with mental, physical, and psychological disabilities are not punished with solitary confinement, the U.S. report asserts:

The Americans with Disabilities Act of 1990 (ADA) and the Rehabilitation Act of 1973 (Rehabilitation Act) restrict and regulate the use of solitary confinement for persons with disabilities. Title II of the ADA, 42 U.S.C. 12132, applies to state actors, while the Rehabilitation Act applies to federal correctional facilities and correctional facilities receiving funds from the federal government. Both statutes prohibit the use of solitary confinement in a manner that discriminates on the basis of disability instead of making reasonable modifications to provide persons with disabilities access to services, programs, and activities, including mental health services. See Pa. Dep’t of Corr. v. Yeskey, 524 U.S. 206, 210 (1998).

THE UGLY TRUTH:  In addition to solitary confinement being systemically used to contain mentally ill inmates, juveniles, and many other prisoners (including those who refuse to work free or nearly free), it is further used to force potentially innocent defendants into plea bargains with trials denied. This typically happens to African Americans. Black people, especially men, are sometimes denied their Sixth Amendment right to fair, speedy, public trials, represented by adequate defense counsel, i.e., Shannon Nyamodi of North Carolina (two years), Terrell Scott of Pennsylvania (five years), and Kalief Browder of New York (three years). Black mental patients regularly experience indefinite detention without trials, which is cruel and unusal punishment. Two unfortunate examples are Mississippi inmates Marktain Kilpatrick Simmons (eight years) and Lee Vernel Knight (seven years).

Numerous commentators at the Solitary Watch article are incredulous over the prospect of the U.S. State Department denying the “systematic use of solitary confinement” in American prisons. Eileen Siple wrote,"In many counties in the US, including Harford County, MD, juveniles charged as adults are automatically placed in solitary within adult jails and prisons “for their own protection”. This can go on for months or years – until they are bailed out, waived down (unlikely), turn 18, or their cases go to trial. Isn’t that systematic?"

How can the State Department deny systemic use of solitary confinement and other torture against American prisoners with evidence and witnesses to the contrary? For example, "Dog Justice for Mentally Ill" blog carries numerous reports and videos documenting brutality and deaths of mentally ill victims in custody, which were also published on mainstream news broadcasts.The denial of systemic prison torture may be possible because a minute percentage of human rights complaints the United Nations receives originate in the United States. In "AIMI vs. the USA," the International Court will be presented with evidence that police and correction officers' often torture, brutalize and sometimes kill mentally ill Americans without incurring criminal charges. Cover-ups are more likely to follow such abuses and deaths. In addition, cruel and degrading treatment against prisoners frequently extends to family members and advocates who demand justice. Following the secret arrest and wrongful death of Larry Neal, this writer's disabled brother who was a lifelong schizophrenic heart patient, his family endured censorship, surveillance, and financial persecution for requesting an explanation about his kidnapping and murder in Memphis Shelby County Jail in 2003.
