Stiff PENALTY for Hiring Americans Instead of Aliens in USA: Senate's Immigration Reform Bill

Update: The issue presented in this article may have been addressed on Tuesday, July 2. The Wall Street Journal reports "the Obama administration said it is delaying penalties for large employers who do not provide health-insurance coverage to workers under the federal health-care law for 2014, the first year the provision was set to take effect. The health overhaul passed in 2010 requires companies with 50 or more workers to provide health benefits to full-time employees or pay fines starting at $2,000 per worker." Objections were raised because implementation of the Senate's Immigration Reform Bill would essentially penalize employers who hire American citizens and legal residents in 2014 but not if they hire former illegal aliens. The implication is that most of our lawmakers do not actually read bills and understand all of their provisions before voting for them, which is very unfortunate. (This concludes the update.)

The Democrat-controlled Senate passed the landmark immigration reform bill Thursday by a vote of 68-32. Fourteen Republicans joined the entire Democratic caucus in approving the bill. It provides a stiff PENALTY to employers who do not give preferential job placement to persons with “Registered Provisional Immigrant” (RPI) status. 

Senator Ted Cruz (R-TX) reports: “I filed an amendment that would have corrected one of the most egregious aspects of the gang of eight bill as it intersects with Obamacare legislation, namely a penalty imposed on U.S. employers for hiring U.S. citizens and U.S. permanent residents. This bill says if an employer hires a citizen or a legal immigrant, the IRS can impose a $5,000 penalty on that employer. But if the employer instead hires someone with RPI status, that penalty will go away. That is utterly and completely indefensible.”

African Americans are plagued with high unemployment more than other communities. The Senate's Immigration Reform Bill in its present state relegates U.S. citizens to being the last choice for jobs and guarantees that unemployed and under-employed Americans will continue the slide to poverty, homelessness, hopelessness, and possibly crime. At a time of austerity cuts in benefits programs that help provide food and shelter for poor Americans, it is particularly offensive to put a $5,000 penalty on employers who hire them. Thanks to Sen. Marijuana Arrests: It's a Black Thang

Who are the victims of mass incarceration? Many are young people arrested for possession of marijuana and taxpayers who shell out roughly $50,000 per year to "save society" from each nonviolent youth with a joint. More than 1.6 million people were arrested for drug offenses in the US in 2010, according to the FBI's Uniform Crime Report 2010, and more than half of them were for marijuana. That's a drug arrest every 19 seconds, 24 hours a day, every day. The numbers suggest that despite "no more war on drugs" rhetoric emanating from Washington, the drug war juggernaut is rolling along on cruise control. The aggressive enforcement of marijuana possession laws needlessly ensnares hundreds of thousands of people into the criminal justice system and wastes billions of taxpayers’ dollars. What’s more, it is carried out with staggering racial bias.

Blacks are four times more likely to endure marijuana arrests than whites, although marijuana usage is slightly higher among whites. Rev. Jessie Jackson and others planned a march on White House on June 17 over marijuana arrests. Arrests may be to eliminate blacks competing for jobs and to take voting rights. Rev. Jackson says blacks are in a "state of emergency" and requests the President's help.

Black and brown youths are probably 100 times more likely to endure warrantless searches of their persons than their white counterparts. The recent "stop and frisk" trial in New York revealed that police were instructed to intimidate minorities and were actually given arrest quotas. The United States Department of Justice is set to investigate New York for a pattern of civil rights violations. See "Atty. Taxpayers have shouldered the cost of arresting and incarcerating hundreds of thousands of people for the possession of marijuana, often in small quantities for personal use. Some national estimates put the annual cost of marijuana arrests above $10 billion, and low-level arrests for marijuana possession cost New York City alone $75 million in 2010.

In Georgia, Gov. Nathan Deal seeks to reduce incarceration of nonviolent drug offenders by diverting them to alternative programs, including drug courts, DUI courts, mental health courts, day reporting centers and expanded probation and treatment options. Other states should follow his lead to lessen the burden on taxpayers and avoid over-prosecution of marijuana users.

Besides the racism and over-prosecution inherent in America's "War on Drugs," many lives have been lost in the war, including police officers and potential defendants. New York police officers recently followed a teen home, entered by force, and shot him to death as he flushed a small amount of marijuana down the toilet. Can you picture that happening to a Caucasian child in an affluent neighborhood? It is time for everyone, especially African Americans and Latinos, to unite and denounce mass incarceration with Rev. Jackson, Dr. Boyce Watkins and Russell Simmons, along with 175 celebrities and public figures in their campaign to end the War on Drugs and Mass Incarceration.  You can learn more at this link. 

The real shame is that the criminal justice system is sometimes used to penalize people for noncriminal behavior. For example, a judge recently responded to an assault victim by demanding sex in exchange for 'legal favors.' She filed a complaint, and he sent cops to plant meth in her car. If the judge had not retaliated against the woman for rejecting his sexual advances, neither he nor the police officers would be in trouble today. Supreme Court: Warrantless DNA Samples OK

Supreme Court: DNA Samples Can Be Taken From Arrestees Without Warrant

The U.S. Supreme Court has ruled that DNA samples can be forcefully removed from arrested persons. Therefore, DNA samples can now be forcefully retrieved and used AGAINST Americans, but DNA test results do not necessarily get used FOR defendants facing long prison terms and executions. I respectfully disagree, justices.

~Please make DNA tests a right in order to safeguard Americans' right to life, liberty and the pursuit of happiness. 

~Please also declare that DNA samples must be held for as long as the inmate is held and for up to a year after incarceration for those inmates and survivors who request a DNA test to prove innocence. 

~Please mandate that forensic labs must meet rigid standards and that states must pay for an independent assessment annually to ensure that forensic labs meet the criteria. People's lives and freedom depend on the accuracy of findings at these labs.

~Please mandate that inmates who continue to deny guilt despite the DNA test results that arresting police took by force have the right to an independent DNA test, because not all police officers are honest.

I am signed in at Facebook, but I was not permitted to use that sign-in to place the comment. I also completed the form to receive a reset on my Huffington Post password (which was stolen during my burglary in August 2012) but did not receive an email with the reset code from Huffington Post. I checked at Google+ to see if I could comment there, but the Huffington Post's last post on my view at Google+ was "The real meaning of Memorial Day..." and was dated May 25, 2013, although this is June 3, 2013. Therefore, I take it that stalkers REALLY don't want Mary Neal to have an active Huffington Post account.
